"Bennett said late Wednesday afternoon that he had reached an agreement with Senate President Karen Fann that would allow him to continue as the unpaid liaison between the state Senate and the companies it hired to recount and examine Maricopa County’s 2020 election. He would not share details of the agreement, but said they would be made public Thursday."

Senator Townsend acknowledges the possibility of legal action to address Maricopa County’s non-compliance and offers an alternative sample path. If Governor Ducey called a special session, the legislature could amend statute 41-1153, which requires a majority vote to enforce a subpoena. The proposed revision would make disregarding a subpoena an automatic misdemeanor (without requiring a vote), which would enable the legislative committee to issue a warrant for the withheld items. Townsend believes there is a chance of convincing Senators Boyer and Ugenti-Rita to vote yes on such an amendment.
