By implying that people of different sexes can have the same gender identity (and therefore, legally, the same gender), it invalidates the deeply felt sense that gender is based just on sexual difference.
A question that posits non-binary options does not ask just about subjective preferences but purports to appeal to some normative principle that applies generally, objectively, and this generalisation of gender is already discriminatory (and contradictory, therefore not normative).
