There is no WA Public Health Order signing into effect the announced wide-reaching "no jab, no job" mandates
The stress and anxiety of the current dire circumstances faced by workers and business owners whose industry falls under the announced jab mandate is palpable, and we feel you. The National Mining and Construction United team includes people in such a predicament, staring down the barrel of a gun – or a needle, as it were – of impending job/revenue loss. So it’s with a shared sense of concern that NMandCU aims to provide its followers with the most objective and accurate information and analysis possible, in regards to jab mandates, and what can be done about them. We don’t want to give ourselves false hope, just as much as we don’t want to provide you with false hope.
On October 9th, we posted that there is no WA Public Health Order (PHO) in place mandating the jab for on-site Mining workers, that was announced a few days prior. Not only is that still the case for Mining, but it’s also the case for the wide-reaching jab mandate covering 75% of the West Aussie workforce announced on October 20th. As far as we're aware, no warning or "grace" period for a declared PHO needs to be given, so we continue to monitor the situation and are under no illusions that a PHO could be published any day, even on the day of the announced mandate deadline.
Current PHOs signed by the Chief Health Officer Dr. Andrew Robertson can be found on these two WA Government webpages [1] [2]. The Government can publish on their online platforms whatever fancy graphics they like to make the mandate announcement look official, but without a PHO, the mandate announcement is just that, an announcement. The same applies to any employer who hasn’t declared its own jab mandate, but is just echoing the Government's announcement. So if you’re someone wondering what your options are, to the point of submitting to a medical procedure that you’re not 100% comfortable with, we urge you to “Hold The Line.” There's no need to adhere to a "law" that hasn't yet been put into effect, and may well never be put into effect.
On October 12th, we posted about “The Fluidity of Jab Mandates,” highlighting instances in Australia where the announced mandate isn’t what ultimately gets signed into effect, or is at least delayed. Since then, we have another couple more examples to point to. Reported by PerthNow yesterday:
“A group of police officers and health workers fighting their employers’ vaccine mandates have been granted a temporary lifeline by the Supreme Court."
“On Tuesday, Justice Jean Dalton extended both groups’ immunities to the direction.”
And despite announcements from VIC Premier Dan Andrews a few days ago that only vaxxed citizens will be able to enter a book or shoe shop, it has now been reported that all retail stores will be accessible without vax status needing to be proved when Melbourne “re-opens” this Friday (source: 7NEWS Australia).
That said, the fluidity of mandates doesn’t mean we do nothing until there is a PHO. We have pinned numerous ACTION STEPS to the top of this channel as suggested ways to challenge the mandate, and we will continue to post more. But a potential way to step around a jab mandate is to alter your working arrangements, so your role falls outside of the mandate requirements. If working from home is an available permanent option in your current employment, we suggest you look into it now. If you can take a different role within your company which excludes you from the mandate, that's also worth immediate consideration.
This is a dark time in history, for the World and particularly Australia, as medical apartheid is rolled out in otherwise free nations. But always hold your head up high that you're on the correct side of history, and "Hold The Line" for as long as you possibly can. We still have time, and we still have lawful options to explore. Together, we can win our medical freedom and our worker's Rights.

Admin have removed the industrial strike action flyers that kept getting posted into comments for a reason. After consulting with lawyers and people from HR we are aware that industrial strike action that is not organised through the proper channels has large financial and criminal penalties for the organisers. It can also result in large fines and dismissal for individuals participating. We don’t condone nor promote “illegal” strike action but we do support and promote legal and diplomatic/democratic ways people can take action.
If we are seen to endorse events and actions such as this then the admin will be the ones dealing with the implications and it makes the whole group vulnerable. This admin consists of 14 people who are just like every one of you and we all face the prospect of unemployment. Our time is given voluntarily and we do not benefit financially in anyway. Some admin are even out of pocket paying for legal advice so we can plan strategies to help everyone.
We are happy to continue to do this however please understand that we must continue to moderate the comments for our own safety as well as the wellbeing of this group. Please avoid any comments that can be considered violent, inciting or encouraging illegal action.
Obviously everyone is entitled to their opinions and ideas, however the admins of this group must promote what is in the best interests of all group members and refrain from posting anything that may cause detriment.

On November 1st, we are calling on every Australian who still believes in the most basic tenants of workers rights, and indeed fundamental human rights, to step forward.
We all have family, friends and colleagues who have been coerced into taking an experimental injection by fear generated through financial, social and political subjugation and division.
We will not allow our government, media nor our employers to divide our family.
On November 1, as a Nation United, we stand up and say "Enough!"

We proudly stand beside each and every one of you, jabbed or unjabbed, in the solidarity of the ANZAC. We owe it to those who fought and sacrificed their lives, to ensure that every Australian who came after them, lived a privileged life of liberty, freedom and peace.
