YER HISOBIGA MAS'UL XODIMLAR UCHUN O‘QUV-SEMINAR

🔹 Davlat kadastrlari palatasi Xorazm viloyati boshqarmasi tomonidan hududiy tuman va shahar filiallaridagi yer hisobotini yuritish mutaxassislari uchun navbatdagi o‘quv-seminar tashkil etildi.

⭕️ Seminarda O‘zbekiston Respublikasi Vazirlar Mahkamasining 30.09.2024 yildagi 614-sonli qarorining mazmuni va mohiyati tahlil qilindi. Qarorda yer uchastkalaridan ruxsat etilgan foydalanish turlari hamda kapital qurilish obyektlarining yagona klassifikatorini amalga kiritish bo‘yicha belgilangan ishlar muhokama qilindi.

⭕️ Shuningdek, "Yer hisoboti ATT" va yer balansining 2025-yil 1-yanvar holatiga tayyorgarligi, hududlarda yer hisobi bo‘yicha amalga oshirilayotgan ishlar va yo‘l qo‘yilayotgan kamchiliklar muhokama qilinib, mutaxassislarga tegishli ko‘rsatma va topshiriqlar berildi.

*️⃣Yer sohasidagi islohotlar bugungi kun hayotimizning barcha sohalari bilan aloqadorligi hamda yerlarni hisobini yuritish va yer uchastkalariga boʻlgan huquqlarni davlat roʻyxatidan oʻtkazish zarurligi har bir fuqarolar oʻrtasida boʻlayotgan bahs va munozaralardagi asosiy mavzulardan biriga aylangan.

*️⃣Barchamizga maʼlumki, yer uchastkalarini ajratishning barcha uchun teng, shaffof va bozor tamoyillariga asoslangan tartibini joriy etish, yerga oid mulkiy va huquqiy munosabatlarda barqarorlikni taʼminlash, yerlarni muhofaza qilish, yer egalarining mulkiy huquqlarini kafolatlash, shuningdek, yerning iqtisodiy qiymatini belgilash orqali uni fuqarolik huquqiy munosabatlar obyekti sifatida erkin muomalaga kiritishga qaratilgan qator islohotlar amalga oshirib kelinmoqda.

*️⃣Yer uchastkalari xususiy sektorga yaʼni yuridik va jismoniy shaxslarga mulk va ijara huquqi asosida, davlat organlari, muassasalari, korxonalari, fuqarolarning oʻzini oʻzi boshqarish organlariga doimiy foydalanish huquqi asosida ajratilishi yoʻlga qoʻyilgan.

*️⃣Shunindek, yer uchastkalarini davlat va jamoat ehtiyojlari uchun doimiy foydalanishga ajratishda ham qator islohotlar olib borilyapti.

*️⃣Oʻzbekiston Respublikasi Yer kodeksining 31-moddasiga muvofiq yuridik va jismoniy shaxslarning yer uchastkasiga boʻlgan huquqi joyning oʻzida chegaralar belgilanganidan, yer uchastkalarining planlari (chizmalari) va tavsiflari tuzilib, yer uchastkalariga boʻlgan huquq davlat roʻyxatiga olinganidan keyin vujudga kelishi belgilangan.

*️⃣Ayrim fuqarolar tomonidan “Yer uchastkasini davlat roʻyxatidan oʻtkazish uchun kadastrga murojaat qildim ammo ishimni hal qilmadi”, degan eʼtirozlarini xam eshitib turamiz gohida. Shuni alohida taʼkidlab oʻtishimiz zarurki, Davlat kadastrlari palatasi va uning hududiy boʻlinmalari tomonidan huquq egasining murojaati bilan yer uchastkasiga boʻlgan huquq vujudga kelganidan keyin yer uchastkasiga boʻlgan huquq belgilangan tartibda davlat roʻyxatidan oʻtkaziladi.

*️⃣Yaʼni koʻrib turibmizki, kadastr organlari yer uchastkasini davlat roʻyxatidan oʻtkazmaydi, balki yer uchastkasiga boʻlgan huquqni davlat roʻyxatidan oʻtkazadi. Bunda, Yer uchastkasi, unga boʻlgan huquqni va ushbu huquq egasini bogʻlovchi tashkilot sifatida koʻrishimiz mumkin. Ushbu jarayonni amalga oshirishimiz uchun yuqoridagi 3 ta maʼlumot boʻlishi zarur.

*️⃣Bundan tashqari yer to‘g‘risidagi qonunchilik hujjatlarini qo‘llashda vujudga kelayotgan muammolarni aniqlash, ularni bartaraf etish, shu jumladan, qonunchilik hujjatlarini takomillashtirish, yerdan oqilona foydalanish bo‘yicha xorijiy tajribalarni o‘rganib, milliy xususiyatlarni inobatga olgan holda joriy etish, yer to‘g‘risidagi qonunchilik hujjatlariga rioya etilishi ahvolini muntazam o‘rganib borish, sohada huquqni qo‘llashning yagona amaliyotini shakllantirish borasidagi takliflarni muvofiqlashtirish ishlari olib borilmoqda.

*️⃣Reforms in the field of land are becoming one of the main topics of discussion among citizens due to their relevance to all aspects of today’s life, as well as the necessity of keeping records of land and registering land rights with the state.

*️⃣As we all know, implementing a fair, transparent, and market-based system for land parcel allocation, ensuring stability in property and legal relations related to land, protecting land, guaranteeing the property rights of landowners, and establishing the economic value of land are part of a series of reforms aimed at integrating land as an object of civil legal relations into free circulation.

*️⃣Land parcels are allocated to the private sector, meaning legal and natural persons based on ownership and lease rights, while state bodies, institutions, enterprises, and citizens' self-governing bodies are granted rights for permanent use.

*️⃣Moreover, several reforms are underway for the allocation of land parcels for state and public needs for permanent use.

*️⃣According to Article 31 of the Land Code of the Republic of Uzbekistan, the rights of legal and natural persons to a land parcel arise after the boundaries of the land are defined on-site, plans (drawings) and descriptions of the parcels are created, and the rights to the parcels are registered with the state.

*️⃣We often hear complaints from some citizens saying, “I applied to the cadastre to register my land parcel, but my issue wasn’t resolved.” It is important to emphasize that the State Cadastre Committee and its regional divisions will register the rights to a land parcel only after these rights have arisen in accordance with the established procedure.

*️⃣Thus, we see that cadastre authorities do not register the land parcel itself, but rather the rights to the land parcel. In this process, we can view the land parcel, its associated rights, and the rights holder as interconnected entities. To carry out this process, the three pieces of information mentioned above are necessary.

*️⃣Additionally, efforts are being made to identify issues arising from the application of land legislation, address them, including improving legislative documents, studying foreign experiences of rational land use, and implementing them while considering national characteristics. There are also ongoing works to regularly monitor compliance with land legislation and to coordinate proposals for establishing a unified practice of law enforcement in this field.
