Yesterday I appeared on behalf of the Defense Council for the Defendant Dragone Goodrider (fictional) v. the case of Prosecutor before the Appeals Chamber of the International Criminal Court MCC. I have within a restricted period negotiated with a set of objective legal grounds of appeal against the case, that the accused did not commit the alleged crime against humanity, in particular, other inhumane acts pursuant to Art-7(1)(k) of the Rome Statute. Conversely, during the proceedings, the Council for the Office of Prosecutor tried to blamestorm the accused with a set of crimes in compliance with the jurisprudence of the Court wich all were lacking in sufficient acuisitorial evidence (before the ICC) to make cognizable reasons to believe. However, by rejoicing my authority over this case, I invited the Court on three interlocutory grounds of Appeal:

Firstly. Fair-trail standards were breached:
i) The interests of justice.
ii) The principle of proportionality.
iii) The right of the accused to conduct his defense in person in accordance with the rulings of the Court.
Secondly. Failure of the PTC (Pre-Trial Chamber) in bearing an unacceptable criminal charge upon the Defendant.
Consequently, that decision breached the principle of Legality or in Latin (Nullum Crimen Sine Lege), Rome Statute Art-22. Because, the requisite requirements of mens rea (criminal responsibility) have not been meet. Since the four core elements which are encapsulated from the case law of the previous tribunals are absent, inter alia:
i) Systematic attack. Including sources, methods, and policy;
ii) Widespread attack. Including a group of targeted people or civilians;
iii) Use of force (an inhumane act).
Thirdly. The ICC's jurisdiction is limited to the extent of its application over the non-state parties.
Pursuant to Art-12 of the Statute, and the Effects doctrine (a type of jurisdiction). Which was seen in the case of ICC v. Myanmar.
Eventually, I eloquently asked the Appeals Chamber to dismiss the Case of Prosecutor, after providing analysis of a research that took almost 11 months of hard work. The Court shall deliberate the final decision, and shall announce it by the end of this month.

Thereby, I expressed my position regarding the present case and provide strong arguments in response to the Defense counsel’s and State counsel’s submissions. Likewise, my appeal contained following arguments:
1) The “standby” counsel appointment and defendant’s removal were justified by the duty of the court to maintain the interests of justice;
2) Goodrider’s acts comply with elements of crime against humanity and fall under Article 7(1)(k) and Article 25(3)(b) of the Rome Statute;
3) The ICC can exercise it’s jurisdiction over the present case due to objective territoriality principle, “effects” jurisdiction doctrine and transboundary nature of the crime.
Having presented above-mentioned arguments, I asked the Court to affirm the Pre-trial Chamber’s decision on Confirmation of Charges and revoke the Appeal.
It is hard to express the fillings, which each of our team members have, pleading before the bench with knowledge that we represent not only our university, but our country and more over the whole Central Asia. Understanding the responsibility that lies upon us, we do not stop developing our skills every day in order to perform better and better.

Assalamu alaykum. We participated in the ICCMCC as a representative of not only our country (Uzbekistan), but the whole Central Asia. Because our TSUL ICCMCC team was the ONLY team from Central Asia. We were so grateful for that🙂🙂🙂. At the same time, it was a great responsibility😬😬😬.
So we (Juraev Khushnazar and Mironshokh Mirodulloyev) have participated in two rounds overall on the 8th and 16th of June. During the competition, there were over 100 teams all over the world, including teams from the most prestigious universities like Oxford, Harvard, Leiden and so on.

Taking this opportunity, I would like to thank the whole TSUL ICCMCC team (Umida Sherkhanova, Barakatulloh Azimi, Guzaloy Solieva, Mironshokh Mirodullayev, Denis Mazur). Approaching the issues more specifically, in the jurisdiction section we have discussed followings:
1️⃣. ICC jurisdiction cannot be established since Goodrider is a national of Wessos, the “conduct in question” occurred in Wessos and Wessos has not accepted the ICC’s jurisdiction. At the same time, they are preconditions for the establishment of the ICC’s jurisdiction under Article 12 of the Rome Statute. All those preconditions are absent;
2️⃣. Defendant’s right to self-representation was violated, there was not implemented mandatory “other reasonable alternative measures” before depriving him of the right to be present at the confirmation hearing and Defendant’s right to choose his own counsel voluntarily was violated.
3️⃣. The spread of H5N8 does not constitute “a widespread or systematic attack” as required under Article 7(1)(k) of the Rome Statute, the requisite criminal intention cannot be established, and the conduct in question cannot be considered “other inhumane acts”.

This was brief description of the trial procedure. However, the real moot court was fabulous since there were three judges who asked both theoretical and practical questions during our pleadings.
