The court found that the administration’s maneuver after her 120-day interim appointment expired where Attorney General Pam Bondi designated her “first assistant” to invoke the Federal Vacancies Reform Act, violated federal law and improperly sidestepped Senate confirmation requirements. The judges held that the government cannot create a de facto acting U.S. attorney simply by delegating all the office’s duties.

The administration has said it will appeal to the U.S. Supreme Court. Las Vegas attorney George Kelesis remains the pending nominee for the permanent post, awaiting Senate confirmation.
This is the second appellate rejection of such appointment tactics in the past year; similar efforts have already been struck down in New Jersey, California, Virginia, New York, and New Mexico.
