The Law for the Prosecution of Those Responsible for the October 7, 2023 Massacre passed its final reading with an overwhelming bipartisan support of 93-0. The Law establishes a carefully tailored procedural framework for the prosecution of those responsible for the deadliest attack on Jewish lives since the Holocaust. The October 7 massacre involved mass murder, sexual violence, and kidnapping on an unprecedented scale, The law includes targeted procedural adjustments to the ordinary criminal process, to ensure that the perpetrators of the attacks are effectively prosecuted while preserving due process guarantees.
The Law does not create new offences, penalties, or retroactive criminal liability, nor does it impose an automatic death sentence. Rather, it authorizes a military court to adjudicate existing offenses under Israeli criminal law, including genocide, terrorism, and wartime offences for some of which capital punishment exists since the early 50’s.
The military court framework stems primarily from logistical and security reasons, while preserving a professional civilian judiciary through the appointment of Supreme and district Court judges. The Law also expressly recognizes the special status of October 7 victims and ensures them a meaningful place within the proceedings.
