On Thursday, Alex Berenson posted a series of email correspondences between Twitter attorneys concerning his 2022 lawsuit against the company. ...

Last year, Berenson sued Twitter after the company issued him a “permanent ban” for his August 2021 tweet opposing vaccine mandates:

Most U.S. Adults Are Declining COVID Boosters as CDC Warns of Health Risks: ‘Relatively Little Protection'

Adults who aren’t current on their COVID-19 vaccine booster doses may have "relatively little remaining protection" against hospitalization compared to those who haven’t been vaccinated at all, suggests a new study from the Centers for Disease Control and Prevention (CDC)...

Dr. Shana Johnson, a physical medicine and rehabilitation physician in Scottsdale, Arizona, was not involved in the CDC study but reviewed its findings.

The good news, Johnson said, is that the bivalent mRNA vaccine protects against the most severe COVID-19 outcomes, including hospitalization and critical disease (ICU admission and death), Johnson said.

The not-so-good news: The durability or duration of protection was not great, she noted.

...As of May 10, 2023, only 1 in 5 , 20% of, U.S. adults had received a bivalent booster dose.

And most of that group had received their last vaccine dose more than a year ago, the CDC reported in the study findings.

Merck Sues U.S. Government to Halt Medicare Drug Price Negotiation

Merck said it sued the U.S. government on Tuesday, seeking an injunction of the drug price negotiation program contained in the Inflation Reduction Act, which it argues violates the Fifth and First Amendments to the U.S. Constitution.

The lawsuit, expected to be filed in the U.S. District Court for the District of Columbia, argues that under the law, drugmakers would be forced to negotiate prices for drugs in the government’s Medicare health insurance program at below market rates.

Merck asserts this violates the part of the Fifth Amendment that requires the government to pay just compensation for private property taken for public use.

Americans pay more for medicines than any other country. The Biden administration’s drug pricing reform aims to save $25 billion annually by 2031 through price negotiations for Medicare.

But the pharmaceutical industry says the law, passed last year, will result in a loss of profits...

Myocarditis and Pericarditis Risk: Heart Risk Following COVID-19 Vaccination

The researchers examined the link between COVID-19 vaccines and heart-related conditions called myocarditis and pericarditis. They studied 50 million people in England who had been vaccinated from February 2021 to February 2022.

They found out that people aged 16 to 39, particularly males, were more likely to be admitted to the hospital for heart-related issues within the first week after getting vaccinated. This risk was seen to be highest after the second dose of mRNA vaccines.

Interestingly, the risk was lower in individuals who had a previous SARS-CoV-2 infection than those who hadn't been infected before. This seems to suggest that the immune response triggered by the virus doesn't increase the risk of these heart conditions after vaccination.

The FDA Pledges To "Stop The Spread" Of Misinformation

It is a tight contest over which U.S. regulatory agency is most captured by industry. But leading the pack is surely the FDA...

The ordeal of the COVID vaccine proved it. So long as the check cleared, the FDA was ready with committee-based approvals for which no one in particular took responsibility. On Aug. 31, 2021, as the FDA was preparing to approve boosters for a variant that had already been superseded, two top officials resigned in protest: Marion Gruber, director of the Office of Vaccines Research and Review, and her deputy, Phil Krause....

And here we are in mid-2023 and agency capture is more intense than ever. No one doubts it. But it never ends with just financial and regulatory corruption. There is another stage, which is suppressing information and censorship. One might suppose that the FDA would have nothing to do with that end of things. But that would be wrong.

The FDA has now joined the censorship crowd, in effect masquerading as the one source of truth regarding pharmaceuticals.

“Inaccurate information spreads widely and at speed,” the agency says, “making it more difficult for the public to identify verified facts and advice from trusted sources, such as the FDA. However, everyone can help to stop the spread. If you see content online that you believe to be false or misleading, you can report it to the applicable platform:”

What follows at the FDA’s site are links to all the mainstream social media platforms and a method of reporting wrongthink. Note especially the invocation of the slogan “Stop the spread.” Yes, we heard that during the whole of COVID...

The FDA is coming very close to saying that if the government does not confirm it, it is not true...

This censorship stuff is no longer an aberration, a mistake made in panic, a secret plot to violate settled norms, or something about which these people are embarrassed once caught. Censorship has become the main agenda of many governments in the world today. It is being codified by the European Union, promoted by NATO, and institutionalized in every regulatory bureaucracy

And there is a feeling of panic in the air about all of this, almost as if these agencies and industries are freaking out about losing control and desperate to regain the monopoly that they believe they once had. They have every intention of ramping up the spying, putting more pressure on social media, and otherwise deploying every trick in the book for clamping down on those who would dare to disagree.

We Tried to Improve COVID Vaccine Labeling — The FDA Said ‘No Thanks’

Health care providers rely on product labeling for accurate, unbiased and up-to-date information on medical products. But current Food and Drug Administration (FDA)-approved labels for the Pfizer and Moderna COVID-19 vaccines are obsolete, misleading and out of touch with regulators elsewhere. Whatever one thought of the initial shots, people are now getting boosted indefinitely with little reliable information about scientific developments.

Take the ongoing uncertainty over whether vaccines reduce viral transmission. We asked the FDA to clarify in labeling that there isn’t substantial evidence that mRNA vaccines reduce viral transmission. This was an easy ask — the FDA has repeatedly stated that effectiveness against transmission remains unproven. The agency said so in December 2020, when vaccines were first authorized, and again in August 2021, when it fully approved Pfizer’s vaccine. The agency still states on its website today: “While it is hoped this will be the case, the scientific community does not yet know if Comirnaty will reduce such transmission.”

Viral transmission is just one of multiple vaccine-related issues for which the FDA has not updated product labeling.

In January, a group of us — current and former FDA advisers and academics from around the country — tried to fix this problem by asking the FDA to make critical changes to official product labels. But four months later, in a 33-page response letter, the agency denied almost every single request.

In doing so, the FDA failed to follow the lead of regulators elsewhere, including in Europe and Japan...
