Council tax challenges update
Most of this article seems on point but we do not agree that there are or will be military tribunals and this is not an argument we would run if dealing with this issue personally.
Also we have repeatedly said and shown that a council tax summons is issued as "in the criminal case of" and this point should be stressed to any court. If you are in a criminal case why are the criminal procedure rules not being followed? If the court wants to argue that it's a civil case it would seem prudent to ask why a summons is used. If the insistence is that somehow it's still a civil case and the powers to issue a summons somehow come from the local government act, the question to then ask is why are the civil procedure rules not being followed.
This article is right on this issue. Council tax hearings follow neither the criminal nor civil procedure rules, so they are not within "the law". They must therefore be operating within a star chamber set up, otherwise known as an administrative court, outlawed in this country for the purposes of hearing cases or handing out sentences.
One would assume the next step is perhaps to go for declaratory relief on this issue. Or see to where such a case could be appealed so the issues of due process and legal rules can be fully discussed.
On the issue of councils being corporations care is needed in the sense that they are statutory corporations, so one should know the difference.
On the point of issuing of summonses, this would seem settled law. It is a judicial process not an administrative one, and therefore these cases seem to fall on this issue alone. We have spoken about this before and will link the post regarding the same again in another post below this one.

According to Bloomberg $5TN of ESG funding has gone on the 'defence' industry. Awkward. As of Q3 2023, over 1,200 ESG funds, pledged to uphold environmental, social, and governance standards - itself another transfer of wealth - have been diverted to invest in shares worth around $5 trillion in the 'defense' aka aggression sector. Hopefully this will lead to a load of lawsuits as the ESG transfer of wealth program was sold as having an 'ethical focus' on 'sustainability ideals'. The US 'Defense Budget' for 2023 came in at $877BN - more than the 10 other highest spending countries combined, including China, Russia, Saudi Arabia and Germany. The 3.88BN alone sent to Israel to fund the Gaza war could instead have funded 451,735 public housing units, 1.322 M children receiving free or low-cost healthcare, 41,490 elementary school teachers, 10.8M households with electricity and 100,563 student loans. The Defense Budget does not defend the US. It subsidises the Defense Industry, lobbyists, defense contractors and bank loans. Taxpayers should have the right to decide how their money is spent.
