WE ARE APPEALING!
All three judicial review cases have officially been lodged for appeal.
> CACV84/2022 | FALCONER v Chief Health Officer
> CACV85/2022 | FALCONER v Commissioner of Police
> CACV87/2022 | FINLAY v Commissioner of Police
The grounds for appeal which are now being drawn up will focus only on the strongest points of contention anticipated to succeed. Further, our sights are fixed towards the Australian High Court if relief is not found in the WA Court of Appeal.
FUNDRAISING
We received an incredible estimated $110,000 in donations since our last update despite the fallout of the judicial review result. We’ve reached agreement with our legal team to continue preparation towards appeal however the urgency for ongoing funding remains, as does our estimated $80,000 worth of outstanding fees for the initial judicial review.
Extraordinary generosity has already been exhibited and continues now behind the scenes allowing our case to continue even though we present as a precarious crowd funded client for any law firm. We remain entirely confident in our representation by Hotchkin Hanly Lawyers and their excellent choice of senior counsel and junior solicitors.

KILL THE BILL– Western Australia
Many of you will be familiar with the legislation introduced into Parliament by Mr McGowan following the end of our 920 days of State of Emergency and may have seen the previous post promoting the Kill the Bill rally on the 11th of October.
In short, without any ministerial oversight, the Police Commissioner will have full power to enforce similar measures put into place during our state of emergency.
While Mr McGowan has absolute majority in both houses, it’s imperative we make ourselves heard on this Bill.
Some action that YOU can take:
👉 Write to ALL members of Parliament and express your concern about this unprecedented transfer of power to one individual without the provision of parliamentary oversight. *** Announcement | Supreme Court Decision Regarding Cost Orders ***
Many things have occurred behind the scenes during the last few weeks and further updates are being prepared following this one.
On the 5th October 2022 Justice J Allanson handed down his decision regarding cost orders for the preceding judicial review where all 3 matters against the Commissioner of Police and Chief Health Officer were dismissed.
Ben Falconer has been ordered to pay only a portion of potential costs anticipated and Les Finlay has no cost orders made against him. Both the brave plaintiffs were ready for a very different outcome to what was delivered.
In his decision, Justice Allanson made the following comments:
“The challenge to the Commissioner's direction raised an important question of wider significance than the discipline of the individual applicant. The issues determined were not confined to Mr Falconer.”
“I consider that there was a strong public interest in having those matters determined, and that the implications of the decision go far beyond the interests of Mr Falconer and the WA Police.”

Huge news from the USA. Whilst they have a different legal system to Australia, with more avenues to challenge laws, this is still a good example for us to highlight that mandates have been overturned in Western legal systems.

JAB MANDATE WORKERS COMP PAYOUT FOR NSW TEACHER
This week, a landmark worker’s compensation win was handed down by the NSW Personal Injury Commission. This potentially paves the way for other Aussie workers to be compensated for psychological injury arising out of or in the course of their employment, due to to the COVID-19 jab mandates.
Similar to how we posted about the judge's order for New York City workers to be reinstated who were stood down by mandates, there is hope we get the justice we deserve. You can view the full decision in the following post, and also read this MSM article about the decision:

Data obtained from South Australian Health under FOI by Senator Antic shows that cardiac-related presentations in South Australian public hospitals dramatically spiked in those aged 15-44 years correlating with the vaccine roll-out.
With this data, as of today - it should be a criminal offence to administer a Covid vaccine to anyone under 45. And any CEO still mandating it to their employees should be jailed.
But as usual the media are covering this up, and not reporting the Senators speech. They have blood on their hands.
