Monday is the day! At 10:15 AM AEST on Monday, August 8th, the AVN's appeal on standing will be heard before the full bench of the Federal Court.

The AVN's solicitor had asked the court to stream this case to YouTube due to the huge interest in watching the previous hearings, and we are awaiting their response. If we do get a YouTube link, we will send out another message to let you know but it may not happen until Monday morning.

N.B. We have just been instructed that COVID vaccination rules have been lifted for attendance at the Federal Court so if you would like to attend in person and are in Sydney, you would be welcome.

⛔️ INJUSTICE DAY ⛔️

It is with regret and sadness that we advise you all that Justice Jeremy Allanson of the WA Supreme Court handed down his judgement earlier today of the Falconer vaccine mandate case.

Justice Allanson determined that both the CHO (State) & Commissioner of Police were justified in their actions by implementing the vaccine mandates.

We note the courts decision but vehemently disagree with it.

While Justice Allanson may be of the opinion that the mandates were "lawful", this certainly does not mean they were moral or ethical.

Not one of us regrets the decision to hold the line and challenge the disgraceful mandates and may this judgement be the beacon of light which shines upon the tyrannical scope of the government.

History will never forget those responsible!

APPEAL OF SUPREME COURT JUDGMENT

Supporters, please read the below.

As most of you would be aware, on the 23rd of August 2022, the WA Supreme Court handed down its judgment on the Falconer & Finlay vs CHO and CoP cases which challenged the lawfulness of the vaccine mandates. All three challenges were dismissed by Justice Allanson, thereby upholding the mandates to be β€œlawful”.

The Falconer/Finlay legal team have reviewed the judgments and believe a number of errors were made and the case should therefore be appealed and go before the Court of Appeal and ultimately the High Court if necessary. Further, we also received advice of a new and perhaps more potent federal court strategy challenging the discrimination aspects against the individual. The intent will be to pursue both cases in parallel getting either or both eventually into the high court.

There is just one very big i$$ue – our outstanding legal bills sit at $195,219.37.

There is a possibility that we may be able to secure pro bono representation that will see the question of bodily autonomy raised through the appeals process. However – this will only be possible if we can settle the current bill by 31st August. The urgency is due to only having 21 days to lodge an appeal.

We find ourselves again asking for your financial support. If you want to see the right to bodily autonomy taken to the High Court, we need to act fast. All industries are currently working at raising funds within their groups and donating to get this underway – but we wont be able to do this without you!

To overcome and defeat an opponent we must be ready to apply more force than is being used against us. If we do nothing, the precedent as set last week may send a message to government that it is OK for your right to bodily autonomy to be infringed upon.

WE ARE APPEALING!

All three judicial review cases have officially been lodged for appeal.

> CACV85/2022 | FALCONER v Commissioner of Police
> CACV87/2022 | FINLAY v Commissioner of Police

The grounds for appeal which are now being drawn up will focus only on the strongest points of contention anticipated to succeed. Further, our sights are fixed towards the Australian High Court if relief is not found in the WA Court of Appeal.

FUNDRAISING
We received an incredible estimated $110,000 in donations since our last update despite the fallout of the judicial review result. We’ve reached agreement with our legal team to continue preparation towards appeal however the urgency for ongoing funding remains, as does our estimated $80,000 worth of outstanding fees for the initial judicial review.

Extraordinary generosity has already been exhibited and continues now behind the scenes allowing our case to continue even though we present as a precarious crowd funded client for any law firm. We remain entirely confident in our representation by Hotchkin Hanly Lawyers and their excellent choice of senior counsel and junior solicitors.

Many of you will be familiar with the legislation introduced into Parliament by Mr McGowan following the end of our 920 days of State of Emergency and may have seen the previous post promoting the Kill the Bill rally on the 11th of October.
In short, without any ministerial oversight, the Police Commissioner will have full power to enforce similar measures put into place during our state of emergency.
While Mr McGowan has absolute majority in both houses, it’s imperative we make ourselves heard on this Bill.
