MEDIA RELEASE
Government mandates revoked … but much remains to be done!
Today, the Premier announced that the government’s vaccine mandates will be lifted from 10 June. The removal applies to most affected WA workers, except for health, aged and disability care workers.
The Premier’s announcement, while welcome, does not involve an acceptance that the mandates were unlawful at the time they were imposed. It also does not mean that the unvaccinated workers whose legal challenges have been supported by funds raised on this site have a right to go back to work or to obtain compensation for their losses.
In reality, all that the Premier has done is to conveniently pass the buck back to employers, both in the public and private sectors. Early indications are that, despite the Premier’s decision, some employers may not be willing to have the unvaccinated back in the workplace and intend to punish them for choosing not be vaccinated. The Police Commissioner, for example, has been reported today in the media as saying that despite the Premier’s announcement, disciplinary action will continue against unvaccinated police, including Ben Falconer, the applicant for judicial review in the Supreme Court.
So, the fight against the vaccination mandates will continue pending further developments. The WA judicial reviews against the government and related employer mandates, generously funded by our donors, will continue to be fought vigorously. The Falconer judicial review against the police mandates is headed for a trial on 13-15 July, with judicial reviews in a number of other sectors waiting on the outcome. Conferral between competing vaccination experts is scheduled for 10 June, coincidentally the day the mandates are lifted.
Also, as previously reported, a second front has opened up with a large number of disability discrimination complaints, across all sectors, being lodged with the Australian Human Rights Commission. These are being separately funded.
It is possible that the government or individual departments may make proposals to settle all or some of the judicial reviews before the trial commences. In the meantime, the work on the cases on both fronts will continue at full speed. Any offers will be considered on their merits at the time they are presented.
In summary, the Premier’s announcement today does nothing to provide justice for those harmed by the mandates. The workers who have had their jobs and lives devastated by the mandates ask for your continued financial support to hold the government and employers to account in the courts.
**This is a developing beast and no doubt a lot of "interesting" things will occur over the next month. Watch this space, you will all be kept in the loop.

Today many workers were able to return to their jobs.
We know there is many mixed emotions surrounding this. From today life will be easier for many that have been struggling while others continue to struggle
For those that are bringing in an income we must ask for your continued support.
It is essential that the judicial review goes ahead for the following reasons
1. We need to get our Healthcare, Disability and Aged Care Workers are still back to work.
2. We need to set case precedence so that this can NOT happen again.
3. A win with the Judicial Review will improve the chances of compensation being sought through "disability discrimination" claims in the human rights tribunal.
It is amazing that this case has been completely funded by average West Australians who want to see justice.
We are so close now, trial is in 1 months time, we cannot let the case fall over. The people deserve to have their day in court and hear what the so called health advice consisted of.

With the mandates dropping last week the landscape has changed quite significantly and as a result the lawyers have been working flat out behind the scenes.
Just in the Falconer Police group we have some being told they can return to work but with discipline continuing, some with no news and therefore have to remain at home while discipline continues and others being told they are set to be removed from duty.
The landscape within the other industries is also hugely different and evolving with some also being refused back to work or fired while others are given the green light to return.
By way of a court update, the State has engaged 2 experts (interesting that we originally weren't allowed 1 but they suddenly can have 2) which has led to their experts and our legendary expert (Petrovsky) conferring together by Court order to ascertain exactly what they do and don't agree on surrounding the justification for mandates. The points that they differ on will be what is argued during trial.
Yesterday (15 June) the Falconer legal team and State were back in court, this time with Falconer requesting a court ordered mediation session. While mediation may seem like a sorry word to some, it is important to note that mediation is a standard process ordered in civil litigation in WA’s Supreme Court. In fact, mediation is considered so important that the Court’s published practice direction describes mediation as being “integral” to the administration of justice.
Despite this, the State advised the court that with Commissioner Dawson’s imminent departure from his position to become WA Governor, he simply would not have the time to attend a mediation session. The State further suggested that a mediation would be “fruitless” and therefore opposed the usual mediation orders being made.
This further highlights the State's contempt for the plaintiff and all other affected workers.
The Court chose not to order any mediation and therefore it is full steam ahead to trial on July 13-15 ⚖️

I want to take this opportunity to remind everyone that Ben Falconer, the wider Police group and all those involved within the other industries remain absolutely committed to seeing this trial through.
They have put their names, careers and reputations on the line for this fight. Their commitment and resolve are unquestionable.
As for trial, make sure you attend if you can, we want the gallery, the overflow gallery and outside packed to capacity every day (July 13-15).
Lastly, let's talk funding. We have raised over $400,000, with the majority of that being from you, the very generous, everyday legends who support the cause. This is such an incredible grassroots movement to be a part of and we cannot thank you enough.
The reality is though, we are $45,000 in debt and we still need to pay for the trial to get up and over the line. It would not be unrealistic to suggest another $100,000 is required in addition to paying off the 45k debt to get this case to the end.
To prevent the inevitable questions about "why can't the lawyers work for free" I want to take this opportunity to remind everyone that we have had a team of 1x Senior Barrister, 1x Junior Barrister, 1x Senior Lawyer (Firm Partner), 1x Senior Lawyer and 1x Junior Lawyer working on this case (and representing 100s of workers from all industries behind the scenes), essentially every single day for the past 7 months!! These lawyers have overheads that they must pay for and we can't expect such fantastic representation over a prolonged period of time for nothing. We owe it to them for their hard work to get them paid!!
In addition to the above, the State are being FAR from 'model litigants' and are purposefully draining our funds as much as possible while they ride the bottomless pit of tax payers funding...
So please, between now and the end of trial, we beg you to dig deep and give what you can. This isn't the Falconer case, this is the Peoples case!!

Firstly - WOW, thank you to all those that attended and for your support.
We also noticed a flurry of donations in the last 24 hours which is so good to see and still much needed - so thank you to our donors also!
We have received advice to be limited with detail for our updates until the trial is completely finished (apologies in advance).
Day 1
> Started with opening submissions by the State led by SC Pettit and Falconer led by SC Prince.
> Acting Deputy Commissioner Kylie Whiteley gave evidence to justify Commissioner of Police internal vaccine mandate and was subject to cross examination by SC Prince.
> Prof. Petrovsky (expert for Falconer) gave evidence re the vaccines and was cross examined by SC Pettit.
Evidence of Petrovsky was not completed and will therefore continue first thing tomorrow morning.
Trial resumes at 10:15am tomorrow morning - we would love to see you all there again!

DAY 2
> Petrovsky finished his evidence.
> Falconer Counsel made the decision not to cross examine State's experts.
> State began closing submissions. This will continue first thing tomorrow morning followed by closing submissions by Falconer Counsel.
Final day of trial begins at 10:15am.
For those that have attended and are wondering why a heap of witnesses aren't required to give evidence and affidavits keep on being referred to etc - this is because most of this case has been dealt with by written submissions from both parties. All of this material along with transcripts from the last 3 days will be available once the trial has concluded.

> Justice Allanson reserved his decision and while he did not give an indication of time he noted priority would be given to this case. If cases in QLD and SA are anything to go by, it is likely 4-8 weeks wait at least.

What a roller-coaster of a journey it has been!
The groups involved have been ridiculed by pro-mandate advocates and the MSM and even copped a bit of criticism from those within our own 'backyard'. Despite this; we persevered, we acted with integrity and we got this thing to trial!
We could not have done it without our supporters (moral and financial) and we cannot say it enough - Thank you, thank you, thank you 🙏
While we await the result of this trial it is important to not rest everything on this case. This is just one avenue we must take in order to expose Government lies and irrational decision making.
This case forced the government to disclose records from the CHO and Premiers Office regarding the mandates. This will now forever be on public record and can be accessed by anyone. This in itself is a massive win as we all know these records would never have been made public if this case did not eventuate.
We encourage journalists and other interested parties to obtain these documents and make your own determinations....
