IMPORTANT ANNOUNCEMENT
We didn't want it to happen but feared it would!
The 'Peoples' (Falconer & Co) Supreme Court Challenge is out of funds.
A bunch of invoices for all industries were recently received which has put us into the red, with a trial still set to occur.
We cannot make this any clearer; if we cannot get sufficient funds, the trial will not go ahead and the government wins.
Just at the moment we have them on the ropes! The case is strong especially with our recent inclusion of expert evidence from Prof Petrovsky.
A trial not going ahead means the potential for a precedent NOT to be set, which means, even if the Government drop the mandates in the coming months, there is no judicial precedent to prevent them from doing it again in the future...
A bunch of very brave men and women have said NO to the mandates and put their name on the line to represent their industries on behalf of the people.
It is possible to raise the required funds. These posts when on-shared can reach well over 10k people. Please put your hand in your pocket and buy these brave men and women a couple of beers worth in the form of a donation.

The Port Hedland Anti-Mandate Motion Council Meeting held on May 11th was a success. Motions 1, 2, and 4 were passed with an absolute majority:

I put forward that the Town of Port Hedland apply to the Supreme Court Of Western Australia, pursuant to Order 56 of the Supreme Court Rules 1971, for Judicial Review of each of the following decisions; all of which are adversely affecting the personal, occupational and commercial interests of, residents of, businesses operating in, and visitors to, the Town Of Port Hedland:

TRIAL UPDATE

Apologies for the lull in posts of late. Many involved in this group were involved in the election process and needed a short break given the undesirable results.
Just reminding everyone that trial for the Falconer Judicial Review is still scheduled to commence 13th July 2022.
There have been rumours swirling that either the trial is not going ahead or it has been pushed out to the end of the year or even next year. This is certainly NOT the case.
We are also eagerly waiting to hear the judgement of a similar case in SA and another similar one in QLD is commencing today!
There are also other litigation strategies going on in the background which involves lodging mass complaints through the Australian Human Rights Commission. This is completely separate to the judicial review but has the potential to have the same/similar desired outcome.
(*Note: Donated funds are not being used for this process - Judicial Review only)
While there may be lull in posts, make no mistake that the legal team at Hotchkin Hanly are working tirelessly every day for all our matters.
As for funding, we had an amazing response to our call out for a desperate need for funds to pay our outstanding legal bills. About 80-90% of the outstanding bills are now covered thanks to your amazing generosity.
It is not unrealistic to presume we will need to raise upwards of around 100k from where we are at now to cover the actual trial. We have a few months to raise these funds and a number of fundraising events are planned so keep an eye out for them.

Dear Hedland Friends and Family,
As many of you know, a Special Council Meeting was held on May 11th and the Town of Port Hedland passed three hard-hitting motions which will challenge Premier McGowan's illegal mandates. With absolute majority, our elected officials in Local Government voted to challenge Premier McGowan's Public Health Orders, McGowan's Booster Mandates and his never-ending extensions on his State of Emergency Declarations. All challenges would be via the Judicial Review process in WA's Supreme Court.
BUT...
In an unprecedented and extremely undemocratic manoeuvre, the out-voted minority Mayor and two of his councillors have buckled to the wishes of McGowanโs Pilbara lapdog - the unelected Port HEDLAND CEO - and called a last minute Special Council Meeting this Wednesday, June 1st at 5.30pm. The specific intention of Wednesday's meeting is the REVOKING OF OUR MOTIONS!!!
Apparently, challenging the Premier is too daunting a task for the Mayor and his fellow minority minions.
WE ARE OUTRAGED...
We need to show them that we donโt accept cowardice from our leaders. We demand our individual rights to choose what goes into our bodies. And we want our community back!!!
As we all now KNOW, the Kung Flu infects and transmits equally between the jabbed and the unjabbed. So why are over 80% of Port Hedland's workforce being coerced into a 3rd (and soon 4th) injection of an experimental gene therapy drug just to keep their jobs? And why are the unjabbed still jobless in a town crying out for workers?
WE HAVE POWER IN NUMBERS!
PORT HEDLAND NEEDS YOU!

NO EXCUSES, WE MUST SHOW UP!

WA to ease strict mandatory COVID vaccination requirements for most workers as new cases continue to slow

Government mandates revoked โฆ but much remains to be done!
Today, the Premier announced that the governmentโs vaccine mandates will be lifted from 10 June. The removal applies to most affected WA workers, except for health, aged and disability care workers.
The Premierโs announcement, while welcome, does not involve an acceptance that the mandates were unlawful at the time they were imposed. It also does not mean that the unvaccinated workers whose legal challenges have been supported by funds raised on this site have a right to go back to work or to obtain compensation for their losses.
In reality, all that the Premier has done is to conveniently pass the buck back to employers, both in the public and private sectors. Early indications are that, despite the Premierโs decision, some employers may not be willing to have the unvaccinated back in the workplace and intend to punish them for choosing not be vaccinated. The Police Commissioner, for example, has been reported today in the media as saying that despite the Premierโs announcement, disciplinary action will continue against unvaccinated police, including Ben Falconer, the applicant for judicial review in the Supreme Court.
So, the fight against the vaccination mandates will continue pending further developments. The WA judicial reviews against the government and related employer mandates, generously funded by our donors, will continue to be fought vigorously. The Falconer judicial review against the police mandates is headed for a trial on 13-15 July, with judicial reviews in a number of other sectors waiting on the outcome. Conferral between competing vaccination experts is scheduled for 10 June, coincidentally the day the mandates are lifted.
Also, as previously reported, a second front has opened up with a large number of disability discrimination complaints, across all sectors, being lodged with the Australian Human Rights Commission. These are being separately funded.
It is possible that the government or individual departments may make proposals to settle all or some of the judicial reviews before the trial commences. In the meantime, the work on the cases on both fronts will continue at full speed. Any offers will be considered on their merits at the time they are presented.
In summary, the Premierโs announcement today does nothing to provide justice for those harmed by the mandates. The workers who have had their jobs and lives devastated by the mandates ask for your continued financial support to hold the government and employers to account in the courts.
**This is a developing beast and no doubt a lot of "interesting" things will occur over the next month. Watch this space, you will all be kept in the loop.
