There have been two significant developments in the lead up to the Police Judicial Review trial in the WA Supreme Court.
First, in the interests of open justice, and given the enormous public interest in the cases, the police applicants, through lawyers Hotchkin Hanly, have made a formal application for the trial to be live-streamed. It is common practice for superior courts throughout Australia, including the WA Supreme Court, to live-stream cases of public interest. Live-streaming of the NSW vaccine mandate cases last year was embraced by the NSW Supreme Court and attracted significant public interest. Despite this, the Commissioner of Police and the Chief Health Officer through their lawyers have formally OPPOSED live-streaming. Justice Allanson will rule on the issue after reviewing written submissions to be filed later this week.
The second significant development concerns expert evidence. In a recent judicial review by the High Court of New Zealand, Justice Francis Cooke struck down the police and defence force vaccine mandates. In deciding that the vaccine mandates were unlawful, Justice Cooke considered expert evidence given by Professor Nikolai Petrovsky of Flinders University in SA, concerning the effectiveness of vaccination in reducing transmission of the Omicron variant. In the judicial reviews to be heard next week, the police applicants have filed an affidavit by Professor Petrovsky in response to an affidavit filed by the Chief Health Officer, Andy Robertson. The Chief Health Officer, however, through his lawyers, has formally OPPOSED the court considering Professor Petrovsky’s answering affidavit.
The question of whether or not the court will allow into evidence Professor Petrovsky’s report regarding the effectiveness of the available vaccines to reduce community transmission, will be ruled upon by Justice Allanson at an urgent hearing to take place tomorrow (Thursday, 24 March).
The question has to be asked; why is it that the State would OPPOSE a livestream of the case and expert evidence?
Are they concerned that their solid justification ("health advice") is not so solid?
This is outrageous by the State but sadly not surprising. We hope common-sense and justice prevails tomorrow.

Not the outcome we were hoping for today...
Justice Allanson DENIED the plaintiff's application to use Prof. Petrovsky as an expert witness. The State argued that they would have to find their own 'counter expert' to rebut Petrovsky's evidence which cannot be done in time for trial and would therefore need to adjourn. As the matter is listed for an urgent resolution (by both parties), Prof Petrovsky evidence will not be led by the Plaintiffs... It will however be available to the Plaintiff's to use when cross examining the CHO under oath.
Regarding the livestream. A decision will hopefully be made tomorrow....
Interestingly the State's reasoning for opposing the livestream was along the lines of 'if the public hear certain things during the trial it may lead to vaccine hesitancy within the community'.......
With all of that said and done. The trial will still go ahead starting Tuesday 29 March 2022.

🚨URGENT COURT UPDATE 🚨
*Trial not beginning tomorrow*
Lawyers for Falconer lodged an urgent directions hearing for this afternoon based on the State withdrawing the CHO affidavit.
Lawyers for Falconer argued that based on the evidence of Professor Petrovsky being disallowed and now the CHO affidavit being withdrawn (by the State), an unfair trial is likely.
The hearing before Justice Allanson this afternoon has been adjourned until tomorrow (Tuesday) at 2:15pm. Justice Allanson will likely decide tomorrow whether the trial will go ahead as is (no CHO, no Petrovsky) or will be adjourned for further negotiations in which case the trial will be delayed.
Either way, one thing is for sure - the trial is not beginning tomorrow morning as anticipated. No doubt this frustrates and let's down a lot of people, but we would rather a delay but fair winnable trial than a rushed unfair trial.
Will keep you all updated!

At FIFO Mining & Construction United (FMCU), we're proud to announce that one of our own is a Federal Election candidate, for the United Australia Party in the seat of Durack. Andrew Middleton is an admin of FMCU, and has written many of the posts on our platform since its creation.
Andrew MCed the December 1st WA Parliament protest, held in response to the mandate deadline for workers in a variety of industries, including mining. This led to the steps of Parliament being carpeted in the uniforms of stood down workers.
In the 2021 WA Election, Andrew was a No Mandatory Vaccination Party candidate in the Mining & Pastoral Region. Later that year, he studied the Australian Constitutional Govt course taught by Prof Augusto Zimmermann, giving him a detailed knowledge of Constitutional Rights eroded in recent years.

While United Services WA remains apolitical, it would go without saying that the values of a number of minor parties running in the upcoming Federal election align with the values of those within the United Services WA.
Now that the election has officially been called (May 21), we thought it would be a great idea to canvas our supporters and give them a voice by creating a survey and making it available to the candidates who request it.
Of course this survey is completely anonymous and you are under no obligation whatsoever to complete it.

We didn't want it to happen but feared it would!
The 'Peoples' (Falconer & Co) Supreme Court Challenge is out of funds.
A bunch of invoices for all industries were recently received which has put us into the red, with a trial still set to occur.
We cannot make this any clearer; if we cannot get sufficient funds, the trial will not go ahead and the government wins.
Just at the moment we have them on the ropes! The case is strong especially with our recent inclusion of expert evidence from Prof Petrovsky.
A trial not going ahead means the potential for a precedent NOT to be set, which means, even if the Government drop the mandates in the coming months, there is no judicial precedent to prevent them from doing it again in the future...
A bunch of very brave men and women have said NO to the mandates and put their name on the line to represent their industries on behalf of the people.
It is possible to raise the required funds. These posts when on-shared can reach well over 10k people. Please put your hand in your pocket and buy these brave men and women a couple of beers worth in the form of a donation.
