THE INCOHERENCE OF SENATOR JACQUI LAMBIE

In voting against Senator Hanson’s Senate Bill yesterday, which would have ended discrimination based on individuals' COVID-19 vaccination status, there was an incoherent and characteristically emotional outburst by Tasmanian Senator Jacqui Lambie.

Following our Statement of Position campaign, yesterday HRA issued a follow up letter to the 170 employers. They also included a template letter for employers to send to the WA Government.

As much as many of us are tired if writing to politicians it us vital that we keep it up at an increased volume. If you have written already then write again. Start writing now if you have not done in the past.

Make sure to attach the best science you can find. Describe what the mandates and restrictions are doing to you and your familys. Now is the time to prey on their conscience!

Book appointments to meet with your local state a federal members. Go on a small group if you prefer. One on one it is much harder for them to ignore us. Of course, always remain respectful and peaceful.

Preferably for maximum effect send your emails to State and Federal. Below are email addresses to get you started. Of course ensure you include your local state and federal members too!

ATTENTION ALL WORKERS - VERY IMPORTANT INFORMATION

The WA Public Health Act (2016) contains a section which stops employers disciplining or terminating employment if an employee complies with the Public Health Order (PHO) direction of not attending a site unvaccinated.

The PHO says you must not attend site if you have not received your first jab by 1 December 2021. If you do not attempt to enter or remain on site, you are complying with the PHO. Section 202(3)(b)(ii & iii) of the Public Health Act prohibits disciplinary action or termination of employees who comply with the PHO direction.

DO NOT RESIGN!! Your job must be held for you, and you can resume work once the PHO ends. It must end eventually, so make sure you understand what this means and tell your workmates to HOLD THE LINE. This section of the Act will be protective and can be used in an Unfair Dismissal claim at the Fair Work Commission in the event of employment being terminated, but we are trying to avoid being terminated.

You can write to your employer stating that the section above confirms your compliance with not being on-site cannot lead to your termination. Ensure you write "Without Prejudice" at the top and centre of the letter.

Finally, anyone on sick/stress leave signed off by your GP due to the stress you’re experiencing from the current jab mandate situation, please look into your superannuation fund's policy for Salary Continuance Insurance (SCI). It’s usually automatically built into your Super, but most people don’t even know they have it. It will pay up to 75% of your monthly salary for up to 2 years while you’re deemed unfit for work due to sickness etc. Wait times of 30-90 days apply, depending on your policy.

The following information has been brought to the attention of the admin of this group.

Expressions of interest are being sought to join in on a judicial review that has been lodged on behalf of the WA Police in the Supreme Court. This is something that will be happening in the immediate future and is being opened up to other industries to jump on board. Details sent to us so far are as follows:

Dear all,

We know a lot of you have an appetite for local legal action here in WA, as most seems to be happening over east.

We are considering following what a group of WA Police have done, through their legal team, commenced an application for judicial review in the Supreme Court of Western Australia against the Chief Health Officer (CHO) and the State of Western Australia. The application seeks orders striking down the CHO’s directions that mandate that all WA Police must have a COVID-19 vaccine by 1 December 2021. SO IT BEGINS!

As for the “joint action” we have sought clarification and it is as follows:
The argument against the CHO and subsequent directions are essentially the same however each industry (plaintiff) would be different in its own way. So if our members are interested, the following needs to happen (urgently).

- Finalise numbers and nominate ONE person to be the named “lead” plaintiff. This lead plaintiff would preferably have no assets (in the event it all turns bad).

- We need to raise 10k (minimum) into a nominated bank account. (Eg. $50 x 200 = $10k, but the more that contribute, the cheaper it will be for all.)

Basically, because the good ‘ole cops paid a lot in the early stages, the initial leg work is now done, so our groups 10k gets us straight “into the game”. Once in, the total bill for the challenge can then be split so it goes without saying that the more the merrier, although hopefully gofundme pays for all/most/some…

Note: The above is ONLY in relation to the judicial review process through the Supreme Court. Hotchkin Hanly can no doubt also assist you with industrial relations matters however that would be completely separate and bear its own separate costs….

This action is completely separate from actions started by AdvocateMe and Maatouk's Law Group, and the Broomhill actions.
