⚖ COURT UPDATE ⚖
Firstly, thank you again to all the supporters that could make it today. It was incredible to see the public gallery jammed as well as further supporters in the waiting area and outside the Court. This support doesn't go unnoticed and it's greatly appreciated!
Although it was quite unceremonious and wasn't a long hearing, what needs to be made clear is today was a BIG WIN for the Falconer (the peoples) team. Justice Allanson ruled against the States application that the Judicial Review against the CHO should be dismissed based on there being "no case to answer". Instead Justice Allanson found there was a case to answer and therefore the challenge against the CHO can go ahead. This is in addition to the challenge against the Police Commissioner which is also going ahead.
The matter was adjourned for another Directions hearing on 24th January and provisional dates have been set for trial - 29-31 March (3 days).
The Falconer legal team are on 🔥 and have won everything the State has attempted to block thus far.
Rumour has it that a bunch of other industries, led by single plaintiff's (but with mass support behind them), are on the brink of lodging their own applications for Judicial Review (watch this space 👀).
To round it out, no one likes writing it or reading it but truth of the matter is it needs to be said - This case / these cases cannot continue without funding. After experiencing so much overwhelming public support, it is a pleasure to announce that the morning of 12 January 2022 saw another victory in Senior Constable Ben Falconer’s on-going court battle to overturn the vaccination mandate imposed on WA Police workers by the Chief Health Officer and the Commissioner of Police.
At a hearing on 23 December 2021 lawyers for the Chief Health Officer and the Commissioner for Police had argued that Senior Constable Falconer’s case was so weak that it should be dismissed without trial. Justice Allanson reserved his decision until the 12th January he rejected the arguments advanced by the CHO and the Police Commissioner, and found that Senior Constable Falconer’s arguments have sufficient merit to go to trial.
This win now paves the way for Senior Constable Falconer’s case to go to a full trial, which Justice Allanson has provisionally listed for 29-31 March 2022.
This morning’s court victory comes hot on the heels of an earlier win. On 24 December 2021, Senior Constable Falconer won an injunction which prevented the Police Commissioner, until trial, from carrying out his threat to sack him for not being vaccinated. Despite the Police Commissioner announcing in a press conference shortly after the injunction was granted that it only prevented him from sacking Senior Constable Falconer, later the same day the Commissioner backed away from this statement, and agreed to give an undertaking not to sack a further 27 police officers.
Senior Constable Falconer’s two court wins have meant that the jobs of all 28 unvaccinated police officers represented by Hotchkin Hanly are safe until Justice Allanson hands down his decision after the trial on 29-31 March.
The Falconer proceedings are listed for a further hearing on 24 January 2022, when Justice Allanson will consider procedural issues for the trial, including expert evidence and the disclosure of documents.
Mr Hemery added that Hotchkin Hanly has instructions to commence seven further proceedings in the Supreme Court against the Chief Health Officer before the Falconer case returns to court on 24 January 2022. The further proceedings will challenge the Chief Health Officer’s directions applying to education, building and construction, mining, fire & emergency services, health, WA correctional facility and critical infrastructure workers, on the same grounds as Senior Constable Falconer’s challenge to the WA police worker direction.
Mr Hemery said, ‘As with Senior Constable Falconer’s case, each of the further proceedings will be commenced in the name of an individual subject to the relevant direction and, if successful, will render unlawful the current stand downs of many workers covered by the directions’. He added ‘Once the further proceedings are commenced, the number of unvaccinated workers whose jobs are presently at risk and may potentially be saved if all of the directions under challenge are struck down by the court is likely to be in the many thousands.’

Premier McGowan has now crossed the Rubicon. The Western Australian government has just banned unvaccinated lawyers and all other staff from attending courtrooms.
I am thankful to journalist Daniel Khmelev for the opportunity to provide my humble opinion about this very serious development. It is available in his article published today in The Epoch times.
There I have expressed my serious concern over this appalling decision and its implication towards clients who use the services of unvaccinated lawyers.
It reads, in part, as follows:
“I’m starting to feel really disheartened, and even distressed, by this whole development because one of the hallmarks of a tyrannical regime is to deny people access to justice,” Zimmermann told The Epoch Times.
“The vaccine is being used as an instrument to preclude members of the legal profession to represent the clients and therefore, what the government is doing is to create difficulties for people to have access to justice, ultimately speaking.”
Zimmermann fears that some parties may now also be restricted in their access to basic legal services, particularly those who are fighting against the government’s vaccination mandates.
“It’s clearly undermining the legal profession in the process because there are some good lawyers who are not entirely compliant with the system, and they are actually more concerned about the preservation of individual rights,” Zimmermann said.
“You already have clients with their own legal counsel, and these lawyers might now not be able to properly represent these clients.”
“So you’re going to have lawyers now that are going to find it very difficult to be able to continue to exercise their role as legal practitioners.”

Yesterday (Thursday 3rd Feb) Justice Allanson handed down his judgement re expert evidence and discovery (disclosure).
It was a win and loss for the freedom team - Justice Allanson denied the ability for Falconer to use an expert witness. However Justice Allanson did order the discovery of all documents pertaining to the CHO’s decision making for mandating vaccines and also the Commissioner's decision making for internally mandating the jabs.
Irrespective of the court case, the employees involved and the community deserve to see the documentation (or lack therefore?) that assisted the CHO and CoP in deciding to mandate the jabs. It's a shame that it takes a Supreme Court case to be able to see these documents....
As for the expert witness - it is important to note that the Falconer case is NOT challenging the "science" behind the efficacy or safety of the jabs (this was done in NSW - Kassam vs Hazzard and failed). Instead the Falconer case seeks to challenge the principle of proportionality and precautionary principle which the CHO is bound by legislation to consider when determining directions. So although an expert witness would have no doubt assisted team freedom, the need for discovery being ordered was far more pertinent.
