Supreme Court decision today for Falconer vs Commissioner of Police.
Falconer granted injunction (meaning he will not be removed from his position of employment) until outcome of trial against Commissioner which is set for January 12, 2022.
Decision as to whether the trial against the CHO order will proceed has been reserved by the presiding Justice pending outcome of Commissioner trial.
Work is being undertaken in the background to ensure all others involved in the Falconer case receive similar injunction protections.
This is a HUGE win for the Falconer legal team BUT it also means the fight is now really ramping up and we need YOUR help.

FURTHER UPDATE
This morning, Justice Jeremy Allanson of the Supreme Court of Western Australia granted an injunction against the Police Commissioner, preventing him from dismissing Senior Constable Ben Falconer for failing to comply with the Commissioner’s direction to be vaccinated. The injunction will remain in place until the final determination of the case. The hearing of the case will be in April 2022 and it is expected that the decision will not be handed down for some weeks or months after the hearing.
After the hearing, Hotchkin Hanly Lawyers made representations to the Police Commissioner on behalf of other unvaccinated police officers, requesting that he undertake not to dismiss any of those officers until after the determination of the case.
The Police Commissioner has now agreed to give the undertakings sought. The effect of the injunction and the undertakings is to preserve the jobs of 25 officers well into 2022, when most of those officers were facing disciplinary hearings and dismissal before the New Year.
The case will come back to Court on 12 January 2022 for further procedural directions which will not affect the injunction and undertakings.

WA GOVT "SAFE TRANSITION PLAN" WEBSITE STILL SHOWS 1000+ CAPACITY PROOF OF VAX REQUIREMENT
On the 3rd of January, WA Health Minister Amber-Jade Sanderson announced the rollout of vaccine passports, to take effect on the very next day. In the announcement, it was declared venues with a capacity of 500 of more people would need to be checking proof of vaccination of all patrons. This was contrary to the announcement made on November 5th, where a proof of vax requirement was specified for venues with a 1000+ capacity, as a part of the "Safe Transition Plan" set to take effect on February 5th this year.
Indeed, the "Safe Transition Plan" website still shows the 1000+ capacity requirement today.
The conditions laid out in this announcement is what WA businesses and society on the whole were preparing for. But with little justification beyond a "successful trial" of vax passports at the New Year's Day Perth Cup racing event, the WA Government has now implemented an even wider ranging vax passport system with less than 24 hours notice.
What possible "health advice" could bring forward the implementation of vax passports, and change the 1000+ person capacity to a 500+ person capacity for requiring proof of vaccination? Why is that health advice not provided to the West Aussie public? How does the health advice justify hospitality staff only being mandated to have 1 dose of a COVID jab up to this point, but patrons entering hospitality venues are required to be double dosed? And does Premier Mark McJackboot care about businesses needing to put more staff on at very short notice, to implement proof of vaccination checks of its patrons?
From a public health perspective, an economic perspective, and of course a moral perspective, the sudden implementation of the vax passport system fails the "pub test." The premise that vax passports is to "keep everyone safe" is not justifiable, particularly from a Government who in 2021, oversaw the worst ambulance ramping record in WA history: https://www.abc.net.au/news/2022-01-03/wa-records-worst-ambulance-ramping-figures-in-history/100735606
The WA Government's "COVID management" agenda is wearing thin with a public sick of being essentially landlocked, and constantly told what it can and can't do. The introduction of medical segregation into WA by the McJackboot Government is the capstone of its "COVID management" agenda, and has enshrined its place in the very worst pages of this country's history.
Vax passports must be scrapped, as quickly as they were implemented.

Firstly, thank you again to all the supporters that could make it today. It was incredible to see the public gallery jammed as well as further supporters in the waiting area and outside the Court. This support doesn't go unnoticed and it's greatly appreciated!
Although it was quite unceremonious and wasn't a long hearing, what needs to be made clear is today was a BIG WIN for the Falconer (the peoples) team. Justice Allanson ruled against the States application that the Judicial Review against the CHO should be dismissed based on there being "no case to answer". Instead Justice Allanson found there was a case to answer and therefore the challenge against the CHO can go ahead. This is in addition to the challenge against the Police Commissioner which is also going ahead.
The matter was adjourned for another Directions hearing on 24th January and provisional dates have been set for trial - 29-31 March (3 days).
The Falconer legal team are on 🔥 and have won everything the State has attempted to block thus far.
Rumour has it that a bunch of other industries, led by single plaintiff's (but with mass support behind them), are on the brink of lodging their own applications for Judicial Review (watch this space 👀).
To round it out, no one likes writing it or reading it but truth of the matter is it needs to be said - This case / these cases cannot continue without funding. Those involved are already self-funding but they need your help. Hiring some of the best legal heads in the country requires $$. So please, if you can, please head over to the GoFundMe and donate. After experiencing so much overwhelming public support, it is a pleasure to announce that the morning of 12 January 2022 saw another victory in Senior Constable Ben Falconer’s on-going court battle to overturn the vaccination mandate imposed on WA Police workers by the Chief Health Officer and the Commissioner of Police.
At a hearing on 23 December 2021 lawyers for the Chief Health Officer and the Commissioner for Police had argued that Senior Constable Falconer’s case was so weak that it should be dismissed without trial. Justice Allanson reserved his decision until the 12th January he rejected the arguments advanced by the CHO and the Police Commissioner, and found that Senior Constable Falconer’s arguments have sufficient merit to go to trial.
This win now paves the way for Senior Constable Falconer’s case to go to a full trial, which Justice Allanson has provisionally listed for 29-31 March 2022.
This morning’s court victory comes hot on the heels of an earlier win. On 24 December 2021, Senior Constable Falconer won an injunction which prevented the Police Commissioner, until trial, from carrying out his threat to sack him for not being vaccinated. Despite the Police Commissioner announcing in a press conference shortly after the injunction was granted that it only prevented him from sacking Senior Constable Falconer, later the same day the Commissioner backed away from this statement, and agreed to give an undertaking not to sack a further 27 police officers.
Senior Constable Falconer’s two court wins have meant that the jobs of all 28 unvaccinated police officers represented by Hotchkin Hanly are safe until Justice Allanson hands down his decision after the trial on 29-31 March.
The Falconer proceedings are listed for a further hearing on 24 January 2022, when Justice Allanson will consider procedural issues for the trial, including expert evidence and the disclosure of documents.
Mr Hemery added that Hotchkin Hanly has instructions to commence seven further proceedings in the Supreme Court against the Chief Health Officer before the Falconer case returns to court on 24 January 2022. The further proceedings will challenge the Chief Health Officer’s directions applying to education, building and construction, mining, fire & emergency services, health, WA correctional facility and critical infrastructure workers, on the same grounds as Senior Constable Falconer’s challenge to the WA police worker direction.
Mr Hemery said, ‘As with Senior Constable Falconer’s case, each of the further proceedings will be commenced in the name of an individual subject to the relevant direction and, if successful, will render unlawful the current stand downs of many workers covered by the directions’. He added ‘Once the further proceedings are commenced, the number of unvaccinated workers whose jobs are presently at risk and may potentially be saved if all of the directions under challenge are struck down by the court is likely to be in the many thousands.’

After experiencing so much overwhelming public support, it is a pleasure to announce that the morning of 12 January 2022 saw another victory in Senior Constable Ben Falconer’s on-going court battle to overturn the vaccination mandate imposed on WA Police workers by the Chief Health Officer and the Commissioner of Police.
At a hearing on 23 December 2021 lawyers for the Chief Health Officer and the Commissioner for Police had argued that Senior Constable Falconer’s case was so weak that it should be dismissed without trial. Justice Allanson reserved his decision until the 12th January he rejected the arguments advanced by the CHO and the Police Commissioner, and found that Senior Constable Falconer’s arguments have sufficient merit to go to trial.
This win now paves the way for Senior Constable Falconer’s case to go to a full trial, which Justice Allanson has provisionally listed for 29-31 March 2022.
This morning’s court victory comes hot on the heels of an earlier win. On 24 December 2021, Senior Constable Falconer won an injunction which prevented the Police Commissioner, until trial, from carrying out his threat to sack him for not being vaccinated. Despite the Police Commissioner announcing in a press conference shortly after the injunction was granted that it only prevented him from sacking Senior Constable Falconer, later the same day the Commissioner backed away from this statement, and agreed to give an undertaking not to sack a further 27 police officers.
Senior Constable Falconer’s two court wins have meant that the jobs of all 28 unvaccinated police officers represented by Hotchkin Hanly are safe until Justice Allanson hands down his decision after the trial on 29-31 March.
The Falconer proceedings are listed for a further hearing on 24 January 2022, when Justice Allanson will consider procedural issues for the trial, including expert evidence and the disclosure of documents.
Mr Hemery added that Hotchkin Hanly has instructions to commence seven further proceedings in the Supreme Court against the Chief Health Officer before the Falconer case returns to court on 24 January 2022. The further proceedings will challenge the Chief Health Officer’s directions applying to education, building and construction, mining, fire & emergency services, health, WA correctional facility and critical infrastructure workers, on the same grounds as Senior Constable Falconer’s challenge to the WA police worker direction.
Mr Hemery said, ‘As with Senior Constable Falconer’s case, each of the further proceedings will be commenced in the name of an individual subject to the relevant direction and, if successful, will render unlawful the current stand downs of many workers covered by the directions’. He added ‘Once the further proceedings are commenced, the number of unvaccinated workers whose jobs are presently at risk and may potentially be saved if all of the directions under challenge are struck down by the court is likely to be in the many thousands.’
