‘Powerful’ Dissenting Opinion by 6th Circuit Judge Likely to ‘Doom OSHA ETS’ According to National Law Review
Although the OSHA vax mandate stay was lifted in a 2-1 decision by a panel of just three 6th Circuit judges, Judge CJ Sutton wrote a muscular dissenting opinion. The National Law Review summarizes:
“Judge Sutton argues that the clear-statement rule dooms OSHA’s ETS. Under that rule, Congress must clearly delegate to OSHA the authority to issue an ETS. He concludes that Congress did not clearly delegate that authority to OSHA in its enabling statue (the Occupational Safety and Health Act) or anywhere else.
Judge Sutton also points to OSHA’s failure to explain why the ETS was ‘indispensable’ or ‘essential,’ which he reasons is necessary for an emergency-rulemaking exception. He also writes that any such explaining would likely fail considering all the other ‘less intrusive, more tailored’ approaches the agency could have taken. Nor, in Judge Sutton’s view, was the ETS directed toward a true ‘emergency,’ as neither masking nor vaccination requirements are entirely new options available to the government.”
What’s interesting is that Judge Sutton delivered his anti-mandate opinion despite his strong, pro-Covid-vaccine stance: “The record also shows the utility of vaccinations. The medical studies to date show that vaccinated individuals face fewer risks of getting the virus and, for those who still suffer breakthrough infections, fewer risks of serious symptoms or death... But the issue here is not that simple. No matter the policy benefits of a well-intended regulation, a court may not enforce it if the agency’s reach exceeds a statute’s grasp.”
The National Law Review concludes, “Agree or disagree with his analysis, Judge Sutton’s thoughtful en banc dissent has emerged as the perhaps the most powerful (and the most narrow) judicial opinion against OSHA’s ETS.”
Law Professor Jonathan Adler agrees. In a Friday evening thread on Twitter, he commented, “Whether SCOTUS focuses on OSHA's specific statutory authority, or major questions doctrine, I suspect a majority will ultimately follow CJ Sutton's lead and stay the OSHA ETS, which can only last 6 months anyway.”

The construction is taking place on state land using state funds, which would make it extremely difficult for the federal government to pursue action against Texas.
In August, the state legislature passed a $1.8B border defense bill, with almost half that amount going toward wall construction, the Examiner reported. “Biden allows open border policies and refuses to enforce laws passed by Congress to secure the border and enforce immigration laws. TX is stepping up to do the federal government’s job,” Gov. Abbott tweeted.
Using Trump’s contractor, the project will start by filling in the gaps in the federal wall “in the Rio Grande Valley, where ~40% of all illegal immigrant apprehensions in our country occur,” Texas Land Commissioner George Bush told NewsNation.

New York Legislation Provides for Indefinite Detention of Unvaccinated at Governor’s Whim | National Pulse
In the next legislative session beginning January 5th, 2022, the New York Senate and Assembly could vote on a bill that would grant permissions to remove and detain cases, contacts, carriers, or anyone suspected of presenting a “significant threat to public health” and remove them from public life on an indefinite basis.
Bill A416 gives the Governor of New York, his or her delegates – including but not limited to the commissioner and heads of local health departments – the right to remove and detain any individuals or groups of people by issuing a single order. The orders only have to include the individual’s name(s) or “reasonably specific descriptions of the individuals or groups.”
It goes on to state that the bill will “require an individual who has been exposed to or infected by a contagious disease to complete an appropriate, prescribed course of treatment, preventive medication or vaccination,” essentially giving the government the right to detain anyone they want and forcibly vaccinate them.
As the language of the bill refers to individuals or groups who are “potentially dangerous,” A416 is a preemptive strike against anyone the department believes has the capacity to “pose a threat” in the future, such as those refusing to receive the COVID-19 vaccination.
The bill has received an overwhelmingly negative response on the NY Senate website. Commenters have stated that, “…This is un-American. It [is] reminiscent of the Soviet Union locking up political opponents on the basis that they were ‘mentally unstable’…”

The CDC's latest count of deaths attributed to COVID-19 vaccines is approximately 20,000, but a study by researchers at Columbia University estimates the actual number is 20 times higher.
The Vaccine Adverse Events Reporting System, or VAERS, reports 20,244 deaths, 106,129 hospitalizations and a total of 965,841 adverse events due to COVID-19 vaccines through Dec. 10.
If the Columbia study's underreporting factor is correct, it would mean that there are nearly 400,000 deaths due to COVID-19 vaccines.
In the study's abstract, the researchers note that "accurate estimates of COVID vaccine-induced severe adverse event and death rates are critical for risk-benefit ratio analyses of vaccination and boosters against SARS-CoV-2 coronavirus in different age groups."
The U.S. Department of Health and Human Services points out that a VAERS report is not documentation that a link has been established between a vaccine and an adverse event. However, HHS also notes that VAERS is a "passive" system of reporting, and it "receives reports for only a small fraction of actual adverse events." Many health care workers have disclosed they are instructed by their superiors not to report to VAERS any harm caused by COVID vaccines.
The Columbia researchers found that more than six weeks after injection, vaccination had a negative correlation with mortality. But within five weeks of injection, vaccination predicted all-cause mortality in nearly every age group, with an "age-related temporal pattern consistent with the U.S. vaccine rollout."
Comparing the study's estimated vaccine fatality rate with the CDC-reported rate, the researchers concluded VAERS deaths are underreported by a factor of 20, which is "consistent with known VAERS under-ascertainment bias."
The researchers said the study "suggests the risks of COVID vaccines and boosters outweigh the benefits in children, young adults, and older adults with low occupational risk or previous coronavirus exposure."
They emphasize "the urgent need to identify, develop and disseminate diagnostics and treatments for life-altering vaccine injuries."

The only COVID-19 symptom that doesn’t show up with a common cold is the loss of smell, Barrett said, but that’s not a “useful tool to differentiate between the two.”

The new variant of COVID-19, Omicron, has exploded onto the scene. This variant is different in five essential ways:
• More infectious and will soon be the dominant variant in the USA
• Less pathogenic
• Poorly matched to currently available vaccines
• Natural immunity is providing good protection against Omicron
• Disease symptoms are more similar to the common cold
The Overton Window of political possibility is the concept that there are a limited range of ideas the public is willing to consider and accept, that politicians can only be effective by advocating policy that fits within the Overton window, and that disruptive groups are the ones who can expand or contract the Overton window.
In a 12/11 Telegram post, Dr. Malone explained, “Regarding the Overton Window: Pharma, BigTech, legacy media, and the government have succeeded in intentionally collapsing what is ‘allowable’ political discourse. Freedom benefits from those who speak ‘radical’ truths which help push it back open. This is a deep strategic and tactical truth that broadcasters like Steve Bannon and Glen Beck understand. They are intentional media warriors that stand at the edge of allowable discourse and continually work to push the window open.”
As some governments are now touting a mandatory 3rd, 4th or even 5th booster, various groups, influencers, and even the WHO to some extent… are beginning to question the whole public policy response in the face of the emerging data about Omicron.
Suddenly, some of the data exposing that these vaccines are not as safe and effective as once thought are showing up on places like twitter and linked-in and the posts aren’t being removed... The WHO is questioning the need for universal vaccination and boosters, even suggesting the boosters may “prolong” COVID. Even some main stream media outlets, such as Real Clear Politics are promoting articles that are outside of the BBC-led ‘Trusted News Initiative’ narrative.
Of course, for those caught in the mass formation psychosis (hypnosis), Omicron still has not been enough to shake their obsession with the vaccines and mandates. However, for the persuadable third – there is a shifting of perspective. With this shift, this expansion of the Overton window, politicians will be able to expand what is politically acceptable speech and maybe will bring some sanity back into this pandemic response by the US Government and the world.

Dr. Martin articulately argues that America was founded on drug trafficking (sugar and opium - min. 6:25), shockingly suggests that Covid may have been an engineered solution to America’s ticking social security time bomb (min. 24:00), weighs in on the Trump vaccine advocacy conundrum (min. 44:35), and notes that it was Republican Presidents who gave pharmaceutical companies the “hall pass” (min. 36:45) that ultimately enabled a BigPharma “coup d’etat on the Presidency” (min. 40:00).
Martin also points out that vaccine manufacturer immunity and valid VAERS data is an overlooked statutory “quid pro quo” (min. 35:00):
“The fact is that as much as the CDC and the FDA try to hide behind what they reportedly say is the error in the VAERS database - what they don’t seem to realize is that by saying there are errors, they are violating the 1986 Act… The 1986 [National Childhood Vaccine Protection] Act [and the PREP Act], which shields manufacturers from liability, [says] that the manufacturers of vaccines are required to keep VAERS accurate… You cannot on the one hand say you’re going to get the indemnity shield and on the other hand say VAERS can’t be trusted — because VAERS is a statutory requirement… That’s the quid pro quo in getting the immunity. If VAERS is wrong, then the immunity is pierced...”
