I’m not an elections lawyer, or a Constitutional scholar. I’ll leave the question of whether Trump can be re-instated as president up to legal experts.
But I know this. Bad things will happen to the Democrats [and RINOs like Rat Raffensperger] if it’s proven they stole the election. All hell will break loose. Democrats are in a world of trouble, and they know it.

Earlier in the week, I asked the question: What if Proof of 2020 Presidential Election Fraud Develops? I mentioned several remedies that have been widely talked about from impeachment to a Pentagon coup to rioting in the streets.
There is another option that theoretically could do that, one based on concepts familiar to Americans, thanks to shows from Perry Mason to Law & Order: “Fraud vitiates everything” and “fruit of the poison tree.”
In 1878, in United States v. Throckmorton, the Supreme Court held that “There is no question of the general doctrine that fraud vitiates the most solemn contracts, documents, and even judgments.” In English, fraud invalidates contracts – and an election is nothing if not a contract. Everyone knows if you sign a contract based on fraudulent information, that contract is invalid. That leads to “void ab initio“ which means that fraud from the beginning taints everything resulting from it.
The other doctrine is one we’ve seen TV lawyers use to throw out evidence against their client because it was obtained illegally. The evidence is inadmissible as the “Fruit of a poison tree.” The Supreme Court, in 1939, explained this in Nardone v. United States which holds that, if a tree is poisonous, so too is its fruit.
This means that, if fraud is shown, the election is invalid. Biden is not president and every action his administration took is void as if it never happened. Of course, that’s never been done in a presidential election but it’s happened a handful of times in lower elections.

Garland Favorito on the 6/21 Fulton County, GA Hearing
Favorito: “I’ve got some good news for you. This case today, the courtroom, every minute of it went exactly the way we expected it to go. Our attorney predicted everything exactly correctly. …We made a modification to our complaint on Friday and that basically trumped their strategy. So we are alive and well.
There’s significant evidence of similar ballot fraud in other [GA] counties, there’s significant evidence of audit totals that don’t match up — like in Fulton — in other counties, and there’s significant evidence of Dominion voting systems flipping votes or actually having foreign influence.”
In an interesting twist, at the end of the hearing, the defendants claimed that the State had already investigated reports of machine-marked (counterfeit) ballots. However, according to Favorito, “if they actually did that, they violated GA law: if they tampered with ballots that were under seal, they should go to jail — that’s 21-2574. In fact, their amicus brief argues that you would be committing a felony to do that. That’s going to be the next big story coming out of GA.”

Dominion was founded in 2003, with a mission to provide electronic voting systems friendly for progressives. Because of such partisanship, it languished with almost no customers for the next 5-6 years, until the Obama administration came to power.
In 2008, Dominion was only used in New York and had an insignificant presence in Wisconsin. This began to change in 2010. Thanks to Obama, Dominion quadruped its market share in just 2 years and had expanded to ~40% of the U.S. by 2020.

Trump 2020 Strategic Advisor: Constitution Does Not Prohibit Trump Reinstatement
Trump 2020 strategic advisor Boris Epshteyn said that he does not believe that the Constitution prohibits Trump from being reinstated if the audits find fraud.
Boris Epshteyn said that no one can state for certain that it would be unconstitutional for former President Donald Trump to be reinstated to the presidency since the U.S. Constitution does not prohibit reinstatement and the issue has never been ruled upon.
During an interview with Dr. Gina Loudon on Real America’s Voice, Epshteyn, a former Trump 2020 strategic advisor, predicted that the matter will land in the nation’s high court.
Epshteyn said that “the interplay of the 10th Amendment” to the U.S. Constitution, the 12th Amendment and Article II, “would suggest that states do have a right to decertify. And from then, it’s an open question what happens next.”
He said that after information becomes available from state audits, “decertification should happen because that’s the correct step from the states. And from then on in terms of deciding what to do about the federal election, well, there’s gonna be an open question,” he noted, remarking that he believes that the matter will go before the Supreme Court.

To analyze current processes to maintain accurate, up-to-date voter rolls, the third-party auditor would review additions, revisions and deletions to the Qualified Voter File. The audit board would also randomly select 20% of precincts from each city with at least 500,000 residents and 10% of precincts from each county for a thorough audit of poll books, ballots and vote tallies from the 2020 general election. 🚨👎
The audit of poll books would analyze when each poll book was generated, whether any electronic poll book was connected to a network after being downloaded, any changes made to a poll book and any recorded challenge from an election challenger, among others. The audit of ballots would log the total number of ballots printed, the number of absentee ballots returned by mail, the time a clerk received each absentee ballot returned on election day and when local clerks delivered absentee ballots for signature verification and tabulation, among others. The audit of vote tallies would review the electronic voting systems used to tabulate ballots in each precinct and include a detailed log of each vote tally transfer.❣️
The entire audit would be under constant video surveillance. 👍
The audit would be required to begin no later than 45 days after the bill takes effect, and the contractors would have 90 days to complete the audit. The bipartisan audit board would then have two weeks to complete and submit a final report.

The bill is expected to be introduced to the House today. On the whole, the bill appears to be close to what constituents have been loudly calling for. One glaring exception is the random selection of precincts for an audit of poll books. But this is the first legitimate step any legislator has taken to listen to the voters, and we need it as a starting point.
