Istraga article: The National Assembly of the Republika Srpska will decide on the Draft of the new RS Constitution tomorrow. Istraga.ba publishes the most important parts. According to the new provisions of the RS Constitution, if adopted, the Republika Srpska can enter into a federal or confederal relationship with other states, the RS is a state of the Serbian people, and the Army of the Republika Srpska is being introduced. The provisions also stipulate that property belongs to the RS.

The preamble to the Constitution of the Republika Srpska states that the RS has continuity with 9 January 1992.

“The constitutional order of the Republika Srpska is based on legal continuity from 9 January 1992, the day of the proclamation of the Republika Srpska, and 28 February 1992, when the first Constitution of the Republika Srpska was adopted; on the historical continuity of the medieval statehood of the countries ruled by the Nemanjić, Kotromanić and other dynasties”, states the preamble to the Draft Constitution

Article 1 of the proposed constitution states that “The Republika Srpska is a sovereign, unique and indivisible constitutional legal entity, confirmed by the will of the people and the General Framework Agreement for Peace in Bosnia and Herzegovina, as an international treaty, and the Constitution of BiH”.

“The Republika Srpska is sovereign over its land territory confirmed by the General Framework Agreement for Peace in Bosnia and Herzegovina, as well as over the rivers, lakes and airspace above these areas”, states Article 2.

The constituency of the RS is abolished

Article 3 states that the Republika Srpska is the state of the Serbian people and all peoples and citizens who live in it and participate equally and without discrimination in the exercise of power.

Article 4, paragraph 1, states that the Republika Srpska independently performs its own legal, legislative, executive and judicial functions, and that it has all state functions and competencies, except for those that are explicitly stipulated in Article 3 of the Constitution of Bosnia and Herzegovina as the competencies of the institutions of Bosnia and Herzegovina.

Article 5, paragraph 1, states that the RS may withdraw from the agreement at the level of BiH.

“The Republika Srpska shall decide sovereignly on its powers, reserving the right to withdraw from the agreement (at the level of BiH) of its own free will,” states paragraph 1 of this article, while paragraph 2 states that the agreement from paragraph 1 may be confirmed by a referendum in the RS.

Article 6, paragraph 2, states that the National Assembly and the Government of the RS may suspend the application of any act, measure or activity of bodies and institutions at the level of BiH that is not based on the Constitution of Bosnia and Herzegovina.

Paragraph 3 of the same article of the Draft Constitution states that laws that are not under the exclusive jurisdiction of Bosnia and Herzegovina or that do not result from an entity agreement do not produce legal effect in the RS.

Paragraph 4 states that laws passed by the Parliamentary Assembly of BiH will be applied on the territory of the RS after they are confirmed by the RS National Assembly.

Possibility of self-determination

Article 9 grants the RS the possibility of self-determination.

“The Republika Srpska has the right to determine itself,” states paragraph 1 of Article 9.

“The Republika Srpska may establish special parallel ties, join in complex state unions of federal or confederal structure with neighboring and other states or groups of states,” states paragraph 2 of the same article.

The proposal also states that the capital of the RS is Banja Luka, and the royal capital is East Sarajevo, with its seat in Pale.

Article 37, paragraph 2, restricts political activity.

“Political organization and action aimed at endangering democracy, violating the integrity of the Republika Srpska, violating the constitutionally guaranteed rights and freedoms, and inciting national, racial or religious hatred and intolerance are prohibited,”
