Though the ATF has now formally appealed Judge O’Connor’s ruling (we those asshats would) the 5th Circuit Court Of Appeals is NOT the ATF’s friend. That court has been openly harsh on ATF’s abuses of power & has steadfastly ruled with in favor of the constitution & rule of law against ATF.
ATF has filed their appeal on the frames & receivers ruling, and a motion to stay O’Connor’s ruling is coming behind it. But the ATF’s chances of succeeding at overturning this ruling OR getting a stay are not good. At all.
