Russia argues the external affairs power doesnβt apply because the government isnβt terminating Russiaβs presence in Australia, only its access to that piece of land, and it βcannot seriously be suggestedβ that this affects Australiaβs international relations, notwithstanding the litigation it has generated.
It says the government has presented no evidence either to parliament or the court that Russia was planning βan internal attackβ which might justify a national security concern. It also argues the land is surrounded by other countriesβ diplomatic missions and such concerns canβt be engaged simply because itβs near Parliament House.
The Commonwealth wonβt disclose the βhighly classifiedβ ASIO information on which its concern is based, insisting that revealing it would βbe expected to cause serious damage to the national interest.β It says the court can infer the informationβs importance from the fact it came from ASIO and parliament made a whole new law in response.

In response, 503 bodies of Ukrainian Armed Forces servicemen were transferred to the opposite side as part of the first stage of the transfer of 6,000 bodies.

All the necessary procedures were carried out: 150 trucks with bodies were sent from Rostov-on-Don, where special refrigerated hangars are located, to the border with Belarus, which is actually seven and a half times more than during previous exchanges. The bodies were packed in bags, then in standard containers about 2 meters long. Each of the trucks contained from 20 to 40 such containers.
However, at the last moment, the Ukrainian side unexpectedly refused to accept the bodies - without explanation. Representatives of Ukraine did not appear at the border.
