These are easy fixes that would restore integrity in our elections

In today's hearing, the attorney for the Maricopa County Board of Supervisors asked Judge Timothy Thomason to quash the subpoena issued by the Senate. Their reasoning was that the ballots are sealed and the Legislature does not have a right to access them. They also had the audacity to say the Senate is trying to conduct an ILLEGAL recount under the guise of an election audit.

Karen Fann & Republican Senate want the Judge to issue an order that upholds their subpoena so the ballots are turned over to the custody of the Senate. The Senate would then hire auditors to audit the machines, software, and physical ballots. The Senate's lawyer, Kory Langhofer, said that since elections are essentially over once a short contest period ends, there would be no logical reason for retaining ballots for two years if not for circumstances like now exist. He noted that the Arizona Constitution directs the Legislature to maintain the purity of elections and make sure voter integrity is protected, and said that's what the Senate is trying to do.

Judge Thomason said "worst case" he would issue an order by tomorrow.

IF his ruling does not uphold and enforce the Senate Subpoena, that would terribly undermine the Senate and the power of the Legislature that is written in the Constitution of the US and our State Constitution, but it is not the end of the line.

We still have two items to watch. We should be receiving updates tomorrow or early next week.

1. Mark Finchem and Sonny Borrelli have said several times in the last few days they intend on meeting with Attorney General Brnovich to ask for a Grand Jury to be convened.

2. Senate Bill 1408 was passed by the Senate and has now been sent to the House. This Bill states that the Legislature's authority to conduct an investigation on any matter "may not be infringed by any other law." It is not yet known when the first House Reading of the Bill is.

Maricopa County Superior Court Judge Timothy Thomason issued his ruling in favor of the Arizona Senate! They can access the 2.1 million ballots from Maricopa County to conduct an audit!

Thomason agreed the Subpoenas “are legal and enforceable.”

"There is no question that the Senators have the power to issue legislative subpoenas. The Subpoenas comply with the statutory requirements for legislative subpoenas. The Senate also has broad constitutional power to oversee elections. The Arizona legislature clearly has the power to investigate and examine election reform matters."

This audit must be done right. We must have a complete, unbiased, forensic BALLOT audit, with each and every ballot scanned individually. The scope of ballot fraud has extended far beyond simply counting the number of ballots. Ballots were designed with specific parameters and ink features and are to be printed according to strict specifications, on paper that conforms to the Safe Act. They are to be handled and distributed in accordance with law. The same kinematic artifact technology that is presently utilized to identify counterfeit currency, bank notes, bonds, stocks, and passports must be used to examine the physical ballot. The latest technology, which can verify a minimum of 20 validation points on each ballot, has been made available to the State Legislature for this forensic audit. This computer-driven kinematic artifact technology results in a completely UNBIASED result. All human opinion is removed, as computer vision, machine learning, and artificial intelligence examine the ballots as they are scanned. Just as the original paper ballots were audited in 2000 for kinematic artifacts, our physical paper ballots MUST also be forensically audited for kinematic artifacts.
