Okay I have an update. It appears that this guy who tweeted about the situation (Data Guru) was not accurate. What this settlement is, is that the County Supervisors will give the Splunk logs and the routers over to a third party, a trusted source which is a former Congressman in Arizona, John Shadegg. Then cyber ninjas will be able to get everything that they want from him. So he is basically a caretaker of the data/ trusted 3rd party and we will still have access, so this is actually a win for us. We will have the information from both the routers and the splunk logs. I apologize for the blood pressure spike and let's see what we get out of this.

Additionally, the demand needs to be that anything that is done with these routers or Splunk logs needs to be done with our Auditors present and observing. Anything and everything they ask for it needs to be provided and it cannot be done somewhere else without observers seeing it done that we trust.
Maricopa County Settlement Agreement

Highlights and Areas of Concern:

1. Congressman John Shadegg will be Special Master. He will hire 1-3 computer technology experts to assist him in responding to the Senate’s questions.

2. The Special Master will have sole authority to hire his expert team. Each team member will sign non-disclosures “stating that no information the team member acquired during their employment will be disclosed, revealed, released, published, or otherwise disseminated to any person or entity other than the Special Master.”

3. Maricopa County’s counsel can “brief any purported grounds for withholding” an answer. The investigatory time period is limited to 10/7 - 11/20.

4. “The Special Master and his team will NOT COPY (to any device or in any form) any of the information they review or observe during the course of their work.”

[Given #2 and #4, how does Cyber Ninjas have “full access”? It sounds like they are prohibited from observing in person and from viewing copies of the data?]

[…]

7. The County has still not produced the digital images of the ballot envelopes, which were commanded to be produced by 7/26/21. They must produce them by 9/22/21.

[…]

9. The Senate agrees upon execution of this agreement to send the AG a letter saying the County has fully complied with the outstanding subpoenas and no further action is warranted.

The County maintains that it does not have the passwords and security tokens and they are not addressed further in this agreement.

Access to Everything We Wanted

Senator Fann remains very confident that the auditors will have full access. What does she have planned? Any chance Shadegg is hiring Cyber Ninjas as his ‘expert team’?😂 The contract doesn’t prohibit it.

I see a lot being made of the selection of John Shadegg as "Special Master" and his previous affliations with many parties including Supervisor Hickman (of everyone's favorite chicken farm fire story). His dad was BFF with Goldwater. He practiced law in Phx, working with several campaigns, was the point man for Gov Evan Mechan's impeachment. He represented AZ 3rd/4th Congressional District from '95-'11. He chaired the Republican STudy Committee, House Republican Policy Committee, ran against Boehner for Speaker in '06, and against Blunt for Whip losing each. Voted against Fed min wage, supported border wall, wanted to investigate CAIR, against ACA, against TARP, supported Tea Part efforts speaking at a rally in Phoenix. Since retiring from Congress has worked with several law firms, often as a lobbyist. As I've said previously, anyone in AZGOP politics has rubbed elbows with many efforts and individuals that in the light of today may not hold our respect or appreciation. That said I've not heard the usual noise about Shadegg. Thus far he seems to have been a selection least objectionable for both parties, which is usually the path they take in structuring an agreement. Again, this is Fann's deal. She seems happy with it.

I've followed the Maricopa audit closely from its inception. Karen Fann has yet to make a move that has proved to be foolish. The same cannot be said of her detractors. While I'm not by nature trusting of politicians, I've extended trust to Fann because she has earned it. I'm content to reserve judgment on the choice of John Shadegg as "Special Master" of the agreement with Maricopa County until and unless an actual problem becomes evident. If evidence of an actual conflict of interest does become evident, I trust that Fann and the Senate will remedy it.
On this post Dave and I differ slightly.

I’m an accountant, an IT person, and more specifically a Systems Architect.

I’m keenly aware of the difference between allowing “our guys” to examine the evidence directly TO SEE WHAT THEY FIND vs using a chosen middleman to act as a buffer.

One of the reasons you do audits is because you aren’t sure what mistakes you’re looking for. You comb through everything before you can render an opinion that the subject matter is “free of material error”.

As it stands now, the people have been denied the opportunity to OPENLY VERIFY that Maricopa election systems were, or were not, remotely accessed during the election. Very substantial people have made such allegations, and other “substantial” people appear to have just made a back room deal to keep that evidence from being fully examined.

I don’t even trust Trump that much. I want that shit examined and not with a dirty lobbyist as any kind of gatekeeper.

If you know any professional lobbyists IRL, like I do, you know they are very much invested in relationships and status quo. They don’t kick hornets nests to see what comes out, or “disrupt apple carts”.

IN MY OPINION

I realize many people may never have much experience in negotiating legal agreements between opposing parties (fortunately for them) but the parties don't "agree" to something where one side totally wins and the other is totally screwed. So please keep that in mind when you're reading quick screeds about this one.

Arizona Recently Processed 673,000 Voter Identities with the Social Security Administration – 58% Had No Match Found

TGP reports: “In the last 10 weeks, Arizona has checked the voter registration credentials with the Social Security Administration (SSA) on 673,560 applicants. This is a huge number considering most states, including Arizona, typically process around 2,500 a month.”

Ordinarily, states use the Help America Vote Verification (HAVV) interface provided by the Social Security Administration to verify the identity of new voter registrations when no driver’s license is provided.

According to TGP, “in the first week of July, Arizona jumped from processing 500-600 a week, to a massive 70,000 a week. This volume stopped on September 10th and is now back down to a few hundred. No match was found on 393,017 — 58% — of the 673,560 voters submitted by Arizona over the last 10 weeks,” which is double the average rejection rate of about 27%.

Is it a coincidence that Arizona checked nearly 700K voter registrations just as the ballot count portion of the audit was ending? The The 10-week surge could also be related to Senator Kelly Townsend’s voter roll clean up bill, SB1819.

The entire 10-year HAVV Excel dataset for all states can be downloaded here from the SSA. CA topped the list of ineligible registrations — 77% of their 8.3M submissions over the last 10 years had no match.

Senate President Karen Fann Discusses Maricopa County Settlement Agreement: ‘It’s a Huge Win’

Senator Fann spoke with Jordan Conradson to review the Maricopa County settlement, calling it “a huge win.” According to Fann’s interpretation of the contract, independent IT professionals chosen by the Special Master will extrapolate everything Ben Cotton and Cyber Ninjas need, including screenshots if necessary.

She added, “we still have 100% full control. …If we need something else tomorrow, if we don’t think they’re being above board with us, we can issue another subpoena tomorrow and we’ll start this all over if we need to.”

Regarding Special Master John Shadegg’s work for Supervisor Clint Hickman🥚 a few years ago, she said, “everybody has done work for everybody around here.”

Fann reassured Jordan that an entire section of Friday’s audit report will cover deleted items and concluded by saying, AG Brnovich will handle “the criminal side of it.

Senator Kelly Townsend’s Recommendations for the Settlement Agreement with Maricopa County

Via @KellyTownsend

“Regarding the Friday compromise and the appointment of the Special Master to retrieve info from the routers and Splunk logs (and to reiterate, I do not support the compromise, but it was signed before I knew it was even happening. So if we are unable to keep this from going forward, these are my minimum requirements) -

At the very minimum, the following needs to happen:

1. Ben Cotton from Cyfir (or someone directly involved in the AZ audit thus far, who knows what they are looking at) needs to be present in person, within viewing distance, at all times when any information is collected and handled by the Special Master's IT team.

2. A chain of custody of all information and action must be collected, preserved, and presented to the Senate as part of the audit.

3. A report must be put together that is comprehensive and complete regarding every action taken. Every question asked, and every request made must be documented and made public.

4. All parties should sign an affidavit under penalty of perjury that all information retrieved and delivered is true and accurate.

5. All proceedings should be on video and live streamed for the public to see except for direct video of sensitive information. If this is not possible due to the agreement that needs to be Revisited and changed.

6. Retention of Records for 24 months.

If any of these requirements are not met then the information gathered and collected shall be considered incomplete and non verifiable. It is not for the public or other Senators not involved in this process to just trust the special master and his IT team. This senator will accept nothing less. If additional requirements arise in the coming days, they will be posted as well. We have come too far to finish weak.

Godspeed.”

Maricopa County Supervisor Steve Chucri Caught in Leaked Recording: The Maricopa County Voting Machine Company Audit and Recount ‘Was Pretty BULLSH*T by the Way(AUDIO) | TGP

On March 22nd, 2021, Steve Robinson and Shelby Busch from We The People AZ Alliance met with Steve Chucri to push for Maricopa County’s cooperation with the Arizona Senate for a full forensic audit.

These brave Patriots have now decided that it is time to release the tapes from that conversation to help defend the audit report from the the county officials’ smears and lies.

Chucri was the only Supervisor willing to meet with residents of Maricopa County to discuss serious election concerns, which he shared. He seemed to agree with the majority of voters who were calling for an audit.

Throughout the meeting, Chucri ripped his colleagues for not standing up for voting rights or cooperating with the Senate.

Chucri even said that the county’s audit, led by the companies that certified the equipment, was “bullsh*t” and speculated that his colleagues were afraid of an audit because their races were so close:

You know what I think it was, in hindsight. Gates got scared because he barely won. And Jack got scared because he only won by 200 votes, and then there was an audit and a recount, which was pretty bullshit, by the way. What would happen in those two races? And that is way too self-serving.
