Automatic Class 2 Misdemeanor for Noncompliance in Zuckerbucks Audit

Class 2 misdemeanors are a category of misdemeanor crimes in Arizona that carry up to 4 months of jail time and $750 in fines, although the fines can increase with surcharges. There may be probation and other penalties, as well, including collateral consequences, community service, and paying restitution.

Maricopa County Releases Mocking Response to AZ Senate Subpoena

The Maricopa County Supervisors issued a sneering rejoinder to the AZ Senate’s third subpoena, calling the audit an “adventure in never never land.”

In a characteristically juvenile tweet, the County summarized “key points to AZ Senate:

• Routers: No means no.
• Passwords: Why demand passwords we don’t have for tabulators you’ve already returned?🤔
• [Envelope] Images: Can’t find what we provided in April? Check Ballot Pallet 46 or subfolder AFFIDAVITS on Lacie hard drive. Or the lab in Montana.”

The response also includes a letter from the attorney for Maricopa County reiterating that the County will NOT offer access to routers, Splunk logs, or passwords. The attorney downplays the data breach, calling it an “incident,” claims that the County is willing to resend the envelope images, and refers the Senate to the County Recorder for the voter records.

In a separate statement, Chairman Sellers added his own quarrelsome two cents: “For months, the Senate’s audit team has had access to the items they need to confirm Maricopa County’s tabulators were not connected to the internet and thus were not hacked during the November General Election.  The certified auditors hired by the County needed just two weeks with the machines and logs that we turned over to the Senate to make such a determination.  They have what they need.

…The Senate and their privately funded contractors should finish their “audit”, release their report and be prepared to defend it in court.”

Senate President Karen Fann Issues Mild Response to Maricopa County and Dominion

In her statement, Senator Fann signals cautious optimism about securing the ballot envelopes and critical voter registration data and notes: “We are weighing our options for securing access to the routers and passwords and will make a thoughtful decision in due course.”

Senator Sonny Borrelli Files Official Request with the AZ Attorney General to Investigate the Maricopa Board of Supervisors

I’m a separate statement, Borrelli writes: “The supervisors are acting as if they are above the law and it is an insult to the citizens of our state… The level of disrespect and contempt from the supervisors toward Senate leadership and the voters of Arizona is appalling. Yesterday the Board of Supervisors ignored the subpoena deadline…I respectfully request the Attorney General investigate this clear violation of the law…”

What Happens NextArizona Law SB1487 ⚖️

SB1487 compels the AZ Attorney General to investigate alleged violations of the law by Arizona counties if a request is made by a member of the state legislature.

The AG then has 30 days to investigate and submit a formal report.

If the investigation concludes that the county has in fact violated state law, the county has 30 days to comply. If, after 30 days, the county has not complied, the state treasurer will withhold funds from the county.

If the investigation concludes that the county may have violated the law, the case is sent to the state Supreme Court on an expedited basis.

SB1487: Violations of state law by counties, cities and towns; attorney general investigation; report; withholding of state shared revenues

“A. AT THE REQUEST OF ONE OR MORE MEMBERS OF THE LEGISLATURE, THE ATTORNEY GENERAL SHALL INVESTIGATE ANY ORDINANCE, REGULATION, ORDER OR OTHER OFFICIAL ACTION ADOPTED OR TAKEN BY THE GOVERNING BODY OF A COUNTY, CITY OR TOWN THAT THE MEMBER ALLEGES VIOLATES STATE LAW OR THE CONSTITUTION OF ARIZONA.

B. THE ATTORNEY GENERAL SHALL MAKE A WRITTEN REPORT OF FINDINGS AND CONCLUSIONS AS A RESULT OF THE INVESTIGATION WITHIN THIRTY DAYS AFTER RECEIPT OF THE REQUEST AND SHALL PROVIDE A COPY OF THE REPORT TO THE GOVERNOR, THE PRESIDENT OF THE SENATE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, THE MEMBER OR MEMBERS OF THE LEGISLATURE MAKING THE ORIGINAL REQUEST AND THE SECRETARY OF STATE.

IF THE ATTORNEY GENERAL CONCLUDES THAT THE ORDINANCE, REGULATION, ORDER OR OTHER ACTION UNDER INVESTIGATION:

1. VIOLATES ANY PROVISION OF STATE LAW OR THE CONSTITUTION OF ARIZONA, THE ATTORNEY GENERAL SHALL PROVIDE NOTICE TO THE COUNTY, CITY OR TOWN, BY CERTIFIED MAIL, OF THE VIOLATION AND SHALL INDICATE THAT THE COUNTY, CITY OR TOWN HAS THIRTY DAYS TO RESOLVE THE VIOLATION.

IF THE ATTORNEY GENERAL DETERMINES THAT THE COUNTY, CITY OR TOWN HAS FAILED TO RESOLVE THE VIOLATION WITHIN THIRTY DAYS, THE ATTORNEY GENERAL SHALL:

(a) NOTIFY THE STATE TREASURER WHO SHALL WITHHOLD AND REDISTRIBUTE STATE SHARED MONIES FROM THE COUNTY, CITY OR TOWN AS PROVIDED BY SECTION 42-5029, SUBSECTION L AND FROM THE CITY OR TOWN AS PROVIDED BY SECTION 43-206, SUBSECTION F.

2. MAY VIOLATE A PROVISION OF STATE LAW OR THE CONSTITUTION OF ARIZONA, THE ATTORNEY GENERAL SHALL FILE A SPECIAL ACTION IN SUPREME COURT TO RESOLVE THE ISSUE, AND THE SUPREME COURT SHALL GIVE THE ACTION PRECEDENCE OVER ALL OTHER CASES. THE COURT SHALL REQUIRE THE COUNTY, CITY OR TOWN TO POST A BOND EQUAL TO THE AMOUNT OF STATE SHARED REVENUE PAID TO THE COUNTY, CITY OR TOWN PURSUANT TO SECTION 42-5029 AND 43-206 IN THE PRECEDING SIX MONTHS.”

ABC News Is Now Reporting Allegations of Election Fraud: Emails Show Officials Rejected High-Ranking DOJ Member’s Request to Intervene in Georgia's Election Certification

As reported by ABC News: Top members of the Department of Justice last year rebuffed another DOJ official who asked them to urge officials in Georgia to investigate and perhaps overturn President Joe Biden's victory in the state… before the results were certified by Congress, emails reviewed by ABC News show.

The emails, dated Dec. 28, 2020, show the former acting head of DOJ's civil division, Jeffrey Clark, circulating a draft letter -- which he wanted then-acting attorney general Jeffrey Rosen and acting deputy attorney general Richard Donoghue to sign off on -- urging Georgia's governor and other top officials to convene the state legislature into a special session so lawmakers could investigate claims of voter fraud.

"The Department of Justice is investigating various irregularities in the 2020 election for President of the United States," [Clark’s] draft letter said. "The Department will update you as we are able on investigatory progress, but at this time we have identified significant concerns that may have impacted the outcome of the election in multiple States, including the State of Georgia."

[Clark’s] draft letter continues: "While the Department of Justice believe[s] the Governor of Georgia should immediately call a special session to consider this important and urgent matter, if he declines to do so, we share with you our view that the Georgia General Assembly has implied authority under the Constitution of the United States to call itself into special session for [t]he limited purpose of considering issues pertaining to the appointment of Presidential Electors."

The emails were provided by the DOJ to the House Oversight Committee, which is investigating efforts to overturn the election results…

ABC then predictably concludes the story with the typical regurgitated, crutch talking points: “baseless claims,” “no widespread fraud,” etc. But the fact that lamestream ABC News devoted half an article’s real estate to outcome-altering election fraud claims by a member of DOJ leadership is a seismic shift.

Senator Townsend Skeptical About the AZ Attorney General’s Ability to Enforce Senate Subpoena | OAN

AZ State Senator Kelly Townsend joined Natalie Harp (starting at minute 6:50) to discuss the latest subpoena enforcement efforts for the Maricopa audit.

Townsend argued that there are statutes governing legislative subpoenas. ARS 41-1153 clearly states that a majority vote is required to hold a person in contempt for noncompliance with a legislative subpoena. To enforce these Senate subpoenas, “we need to be in session… and convince Paul Boyer [and Michelle Ugenti-Rita] to join us.” The legislature voted to adjourn for the year in late June.

Unless other crimes were committed, “my prediction is that he [the Attorney General] is going to say: until that law is changed, we can’t forcibly make them hand this over,” Townsend explained.

Senator “Gunny” Borrelli has a different take. In his 1487 request to AG Brnovich, he cited statute 41-1154, which states:

“A person who, being subpoenaed to attend as a witness before either house of the legislature or any committee thereof, knowingly fails or refuses without lawful excuse to attend pursuant to such subpoena, …or to answer any material or proper question, or to produce, upon reasonable notice, any material and relevant books, papers or documents in his possession or under his control, is guilty of a class 2 misdemeanor.”

Although 41-1154 does not reference a requirement for a resolution of contempt (which passes by majority vote), Townsend appears to be arguing that it is nevertheless linked to the provisions in 41-1153.

“There are alternative solutions,” Townsend continued. One option may be the Auditor General, which is typically restricted to financial audits but has stronger punishment provisions for subpoena disobedience and works under the Senate.

“There was a lot of discussion [in the Senate] today. We don’t want to just leave it as is… I know [the audit] is not going to come up clean,” Townsend concluded.
