Cyber Ninjas Quietly Go to Arizona Supreme Court Over Right to Change Judge in Arizona Republic's Audit Records Case | AZ Law Blog

The Cyber Ninjas quietly filed a Special Action Petition last night with the Arizona Supreme Court, stating that they should be able to ask for a new judge in the election "audit" records case brought by the Arizona Republic newspaper.

The news organization filed a special action in Maricopa County Superior Court on June 30th seeking financial records and communications about the audit from the Senate and Cyber Ninjas.

The Republican Party is not involved in this lawsuit, but Cyber Ninjas' attorney Jack Wilenchik argues that Judge Hannah shows "actual bias and prejudice" against the Arizona GOP and "conservative causes".

Senate President Karen Fann and Senate Liaison Ken Bennett Issue Statement

The statement affirms that Bennett will remain audit liaison: “Ken and the Senate team will have full access to all audit work spaces, procedures and data” and Ken will “preserve and protect the strict confidentiality of all information, findings, results, and conclusions until the time they are appropriately communicated in final report(s)…”

Other Senate-Approved Audit Tasks

@JellenneAZ points out the buried lead in today’s joint statement from Senate President Karen Fann and Ken Bennett. The release notes that Ken and the Senate team will continue working on “other Senate-approved audit tasks outside the scope of work contracted with primary auditor Cyber Ninjas.”

In his Monday interview with James T. Harris, Ken discussed his interest in overseeing additional portions of the audit not included in the original Cyber Ninjas manifest. For example, Ken would like to review the signatures on the 1.9M mail-in ballot envelopes and check the accuracy of the ballot tabulation images.

AZ Audit Team Vacates Fairgrounds —Spokesman Randy Pullen Suggests More Space May Be Needed

The Senate’s lease for the Wesley Bolin Building, where the audit team relocated in late June, ends on Saturday. 

However, the departure from the fairgrounds may not be permanent. Depending on what the county and Dominion provide in response to the subpoenas before the 1 p.m. Monday deadline, the election review team may need more space, audit spokesman Randy Pullen said. For example, if Dominion turns over the passwords, the team led by Florida-based cybersecurity company Cyber Ninjas may need to take possession of the county’s voting machines again, which Pullen said would require about 1,000 square feet of space. If the county provides ballot envelopes, that will take up space as well. 

The response to the subpoenas will also determine how long it takes the audit team to complete its final report. Pullen said the team began working on the report a week ago.

Automatic Class 2 Misdemeanor for Noncompliance in Zuckerbucks Audit

Class 2 misdemeanors are a category of misdemeanor crimes in Arizona that carry up to 4 months of jail time and $750 in fines, although the fines can increase with surcharges. There may be probation and other penalties, as well, including collateral consequences, community service, and paying restitution.

Maricopa County Releases Mocking Response to AZ Senate Subpoena

The Maricopa County Supervisors issued a sneering rejoinder to the AZ Senate’s third subpoena, calling the audit an “adventure in never never land.”

In a characteristically juvenile tweet, the County summarized “key points to AZ Senate:

• Routers: No means no.
• Passwords: Why demand passwords we don’t have for tabulators you’ve already returned?🤔
• [Envelope] Images: Can’t find what we provided in April? Check Ballot Pallet 46 or subfolder AFFIDAVITS on Lacie hard drive. Or the lab in Montana.”

The response also includes a letter from the attorney for Maricopa County reiterating that the County will NOT offer access to routers, Splunk logs, or passwords. The attorney downplays the data breach, calling it an “incident,” claims that the County is willing to resend the envelope images, and refers the Senate to the County Recorder for the voter records.

In a separate statement, Chairman Sellers added his own quarrelsome two cents: “For months, the Senate’s audit team has had access to the items they need to confirm Maricopa County’s tabulators were not connected to the internet and thus were not hacked during the November General Election.  The certified auditors hired by the County needed just two weeks with the machines and logs that we turned over to the Senate to make such a determination.  They have what they need.

…The Senate and their privately funded contractors should finish their “audit”, release their report and be prepared to defend it in court.”

In her statement, Senator Fann signals cautious optimism about securing the ballot envelopes and critical voter registration data and notes: “We are weighing our options for securing access to the routers and passwords and will make a thoughtful decision in due course.”

Senator Sonny Borrelli Files Official Request with the AZ Attorney General to Investigate the Maricopa Board of Supervisors
